In the fall of 2000 Jean posted quite a few records of the early Lee
County, Virginia land records. I have gone through these and I noticed that
the deed
Zachariah recorded in 1819 was not included. Here is what that document
says:
This indenture made the Twenty Second day of December in the year
of our Lord one thousand eight hundred & nineteen between Isaac
Burkholder of the County of Botetourt and State of Virginia William
Moorman his attorney lawfully appointed for the purpose of the one
part and Zachariah Wells Senior of the County of Lee and state
aforesaid of the other part Witnesseth that whereof heretofore the said
Zachariah Wells Senior by Deed from Robert Preston and the said Isaac
Burkholder by Deed from John Preston John Preston dated the 11th day
of March 1801 each became possessed as tenants in common of an
undivided ??? of a certain tract or parcel of Land lying and being in the
said County of Lee on both sides of the Powels River including the long
bottom which tract or parcel of Land as patented in the name of John
Breckinridge and Robert Preston by Grant from the Commonwealth of
Virginia bearing date the 25th day of March 1791 and containing nine
hundred acres and bounded as followeth to wit Beginning on the north
Bank of the said river at the junction of the three forks of the said river
at two black oaks & a white oak and running from thence S65 degrees
W 650 poles crossing Several branches to a poplar & ash & three white
oaks on a rocky flat opposite a big gap in Powels mountain thence S46
degrees E 160 poles crossing the river to a white oak near the foot of
said mountain and along the same N79 degrees E 722 poles to a white
oak Thence N46 degrees W 320 poles crossing the river to the Beginning
and whereas the Said Isaac Burkholder the Said Zachariah Wells Senior
being desirous to sever their joint interest in the said tract or Parcel of
Land and hold their several mociles (domociles? therein absolutely and
separately have this day the Said Isaac Burkholder by his said attorney
William Moorman and the said Zachariah Wells Senior in his proper
person agreed upon and marked a Division line across the tract of Land
which is hereby agreed shall separate & divide the interest of the Said
parties to the said Tract or parcel of Land to the said Zachariah Wells
Senior shall hold that end of the said tract of Land which lie above or
north of the said Division line absolutely and full from the claim or
demand of the said Isaac Burkholder and that the said Issac Burkholder
shall hold that end of the said tract or parcel of Land lies below or south
of the said Division line absolutely and free from the claim or demand
of the said Zachariah Wells Senior which Division line as this
agreed upon & marked by the parties Begining on the first line mentioned in
the said tract or parcel of land on the north bank of the said river opposite
a
big bend at the mouth of a branch at a maple sycamore & birch and running
up the said Bank of the river with the meanders thereof one hundred and two
poles to a sugar tree & Stone set by the said parties on the bank of the
river
thence S44 degrees E crossing the river to the back line of the said survey
Now therefore in consideration of the promises and of one dollar in hand paid
to the said Isaac Burkholder said all paid by the Zachariah Wells Senior the
receipt whereof the said Isaac Burkholder by his said attorney doth hereby
acknowledge he the said Isaac Burkholder by his said attorney doth this day
granted remised released & conveyed and by these presents doth grant
remised release quit claim and convey unto the said Zachariah Wells Senior
his heirs & assigns all the right title claim interest or demand whatsover
which
he the said Isaac Burkholder hath in & to that end of the said tract or
parcel of
land which lies above or north of the division line agreed upon marked and
inscribed as aforesaid and the said Isaac Burkholder by his said attorney for
himself and his heirs doth hereby Covenant and agree to and with the said
Zachariah Wells Senior his heirs and assigns that he the said Isaac
Burkholder and his heirs the said upper or north end of the said tract or
parcel
of Land from the said division line as above described to the said Zachariah
Wells Senior his heirs & assigns free from the right title claim or demand of
him the said Isaac Burkholder and his heirs or of any other person holding
under or through him will warrant & forever defend in Witness whereof the said
Isaac Burkholder by said attorney William Moorham hath hereunto subscribed
his name and affixed his seal the day and year first before written

I have tried to copy this exactly as written which was without
punctuation
and the miscellaneous capitalizations. The word that I could not figure out
looks like moreby. In my next email I will discuss this land purchase and
Zachariah's distribution of this land to his son's Jacob, Robert and Thomas.
Also over the next few weeks I will be discussing each of Zachariah's
children and relate what documentation there is for their time in Lee County,
Virginia.
