Beginning March 2nd, 2020 the Mailing Lists functionality on RootsWeb will be discontinued. Users will no longer be able to send outgoing emails or accept incoming emails. Additionally, administration tools will no longer be available to list administrators and mailing lists will be put into an archival state.
Administrators may save the emails in their list prior to March 2nd. After that, mailing list archives will remain available and searchable on RootsWeb
I've been having this same problem with someone who has started a Pierce County
Biographies page. She is going onto the website and pulling the biographies
that I have already placed online. Didn't even ask.

You are not the only one.
I am fighting the battle of someone stealing my cemetery transcriptions.
I walked the cemeteries, transcribed the cemeteries and they didn't even
have the courtesy to change my pages even a little bit, even the code is
exactly the same.
Top that off with the fact that he then copied the same pages and put them
on the area Historical society website and has the society has claimed
copyright on the data.
There are some days I really wonder what mushroom cloud is hanging over my
head.

Hi Linda,
I used the abuse form that is on the GeoCities website at
http://add.yahoo.com/fast/help/us/geo/cgi_abuse and stated exactly the
page that is a problem (at least to me):
http://www.geocities.com/sneezykat2003/RuskSawyer/exeland.html
I also stated that materials found on the above stated page were copied
directly from these pages:
http://www.rootsweb.com/~wisawyer/cemeteries/exeland/windfall.htm -
Windfall Cemetery section of her page.
http://www.rootsweb.com/~wisawyer/births/pre1907delayed.htm - Pre1907
Birth Index section of her page.
(the Exeland Genealogy Windfall Cemetery section of this page came from
some other source. I do not claim this as a copy of my materials and
told GeoCities so, as I felt that honesty and straightforwardness is
important when dealing with this. I have to wonder where she got this
info from though!)
http://www.rootsweb.com/~wisawyer/communities/exeland.htm is where she
copied the "Development of Exeland" from, and
http://www.rootsweb.com/~wisawyer/communities/meadowbrook.htm is where
the "History of Meadowbrook" came from.
I also explained that I have a notice on the bottom of each page stating
that the contents are my property and can only be used with my
permission and that that permission was never asked for by her. (I
would've denied her anyway!) and told them that she has made a common
practice of this type of activity on other servers as well. I filed
this yesterday morning, but have not heard anything back from them.
Will I? Or will it be ignored? I know I never received any responses
from WebTV/MSN either.
It will prove to be interesting, whatever happens. Thanks to you all
for your ideas and your support. It means alot to me.

So, if geocities receives a large number of e-mails from concerned individuals
indicating that a portion of SneezyKatsHome site information, which was

Don't forget the value of your research work in compiling this data. Time
and effort translates into money...$20 to $30 per hour presently, and no
certification or licensing is required for genealogical work, so even if you
are not a "professional", your worktime has monitory value. Plus traveling,
copying, printing, and lodging; it adds up. Incidentally, if you wish to
make the point that your posting was up before hers, your PC files and FTP
programs log the date that the information was entered and posted, and that
will come in handy. Suggestion: Send her an itemized bill, charging her for
the use of this purloined information, to pay in one large lump sum or
monthly payments, and give her the chance to avoid payment by removing the
postings immediately. Don't make threats you can't or won't back up, let her
abundant imagination come up with several serious consequences. Courts take
a pretty dim view of people stealing from free access human services sites.
She may already know what losing a court action is. What is the address of
her bogus posting so others can check to see if their work has been
pilfered? Could lead to a combined effort.

Tina and all,
So having a notice such as the one you state below (or a reasonable
facsimile thereof) should prevent anyone from taking that information
and putting it on their websites, right? What do we do when someone
still goes ahead, takes it, changes it ever so slightly, and puts it on
their website? Can we pursue this in any way?
I just found several more pages that have been copied. I'd gotten used
to the fact that my own work was being taken and claimed as this
person's (the infamous 'Sneezy'), but when work that has been donated
(by one of our very own CCs no less! - Debbie Barrett) gets copied, that
makes me pretty upset. Do we have any legal standing when this stuff
happens? I've already filed a complaint with the server/hosting company
that this information has been found on. Will it do any good?
Just curious,

Paula and all,
Ancestry and Rootsweb have no claim to photos or data on county sites.
It is a very good idea to include a copyright notice on your sites. The
copyright notice I use on many of my pages (I didn't write it) clearly
illustrates the reason for my "no".
__
Copyright Notice: All files on this site are copyrighted by their
creator and/or contributor. They may be linked to but may not be
reproduced on another site without specific permission from webpage
[creator/email address] and/or their contributor. Although public
information is not in and of itself copyrightable, the format in which
they are presented, the notes and comments, etc., are. It is however,
quite permissible to print or save the files to a personal computer for
personal use ONLY.
__
However, *with* or *without* a notice, neither Ancestry nor Rootsweb
have any claim to the contents county sites.
Hope this answers your concerns.

Thanks Tina-
I didn't think they did - but just wanted to double check as I had a
researcher ask me about this and wanted to me sure I was giving out the

Thanks to all of you who offered me information on the copyright law. I did e-mail the US copyright office, and their answer was that anything published prior to 1923 is in the public domain. It appears that anything published 1923 and after, whether it contains a copyright or not, falls under copyright and cannot be reproduced.
I am still going to offer lookups in the books, the centennial books have a lot of good information I can share : )

Hi Anne,
You have tried to be nice and gracious and even to explain how everyone
basically is doing their sites. If they want to sue you, tell them to go
for it.There isn't a court around that will take this to heart and do
something with it. I know this because I have a lawyer who helps on
Sheboygan County and I sent her your note to see if this could be done. She
laughed and told me to tell you to tell them to knock themselves out. You
are not charging a fee, it is no different then if they looked up the
census or vital records themselves and they couldn't sue anyone to change
that either.
Don't let it get to you and certainly don't let them bully you,
Debie Blindauer
Sheboygan & Calumet County
I absolutely agree with Tina and Paula. Send them to the original source of the
document to make changes. We are not able to change historic documents. We are
supposed to take HER word for it? Out of the clear blue? Just because SHE says
so? This sad soul is taking personal problems out on you rather than dealing
with the real problem, but that does not help you. I think this may be one of
those folks who expect to just get the information handed to them, complete.
There are getting to be more and more of them. Folks who just get (demand) info
from others and do not actually work to find it. They seem to think that is
genealogy. One thing you can count on, miserable people will always find someone
else to take their angst out on, and quickly, too. Misery loves company. You
offered to add her way of spelling the name, that's all we can do. Point her in
another direction (government) and click, then, let it go.
I got a goodie today as well. Probably shouldn't be miffed, but I just can't
believe the gaul of some folks. I had very carefully taken the time to send my
own thoroughly researched descending chart on this family to her, even though
she is not related, because the families were once very close for several
generations. It did include and explain that all the full dates, death locations
and burial locations that I was able to obtain were there. Here is what I
received:
hi, rita. can you do me a favor and send me this without generations 5, 6 and 7
(if it's there)? it's too long to fit into my FTM notes section with all the
extra current day folks!
also, if it's not too much trouble, full birth and death dates (and death
location) and BURIAL location. I don't need the sourcing on this since it all
gets credited back to you in my FTM file.
Note the big "thank you" for sharing my years of work. I am so tempted to say
"really busy, no time for doing favors, too much trouble." ;0}

Hi Anne-
I'm not sure what this person thinks he/she can sue about - but what is the
original record? If it is a birth, death, marriage record. I would refer
them to the vital records at the state level where he/she can pursue the
legal road to get the incorrect information corrected. If this is some other
resource they want corrected - I would direct them to the where the original
source is (if you know) so he/she can persue proper route of correcting the
misinformation. Only a suggestion of directly this person to the proper
place of getting the information corrected and then saying little. Sounds
like no matter what you do this person won't be satisfied.
It sounds like this person is "new" to family research and doesn't have a
clue!! It's always that squeaky wheel!
Keep up the great work and don't let this person get to you!!

Good afternoon,
Just wondering if any of you had the same experience...
Person visits the site, doesn't find much, you take them under your wing and
spend a couple hours searching their family, you find their missing
link...Person is happy but disgruntled as they weren't able to find info as
the name was spelled wrong....now threatens to sue / lawsuit unless you
correct the data....I explained it is copied as we see it, etc. but they want
the original extracted record CORRECTED...not just a note added -- completely
fixed to their changes.
I tried to be gracious and explain we are volunteers, we copy & transcribe
records even though we know the spellings might be off....and I even state
the spellings are as the enumerator or vital record was written...still not
good enough....
I know, for every whiner, there's 20 who appreciate us....
Anne
FYI.

Hi all,
This is my understanding from a biography book that was reprinted in our
local town.
The reprint book I cannot use~ But if I have the original book and do not
duplicate the form the reprint is in. AND is prior to 75 years.. it can be
done. Copyrights are automatic even if not done through the system.
Good Luck
