Limited in the cxase of "permanent" display indicates that the submitter sets
the limits.
ONE problem these bylaws are designed to address is the copyright issues of
the submitters, they are designed to make it clear that USGW Project doesn't
"own" the copyright. It is a limited permission to display, and the copyright
is still in place with the creator of the data.
The current "permanent" display promoted by the USGenWeb Archives Project
(A renegade "Project" trademarked out from under the control of USGenWeb) is
not a USGenWeb Policy, but rather the policy of Linda Lewis, who has
trademarked the Archives under her own name, set up her own rules, and
will not submit the archives to USGW control. There are factions in USGW
that support her in this action, so to this point her "project" is still
linked to the main project. However she DOES NOT allow submitters to withdraw
data once it is submitted.
Since that "project" is now under her personal control, there is nothing
USGW can do legally to force her to abide by our bylaws, except to "delink"
her .
She does OWN the "USGenWeb Archives Project" name legally, and has registered
it federally.
There is a unanswered assumption that submissions to that project are
submitted to USGenWeb Project, that she does not dispell. However submissions
are NOT under the USGenWeb Projects control, and it will be a real "thorn"
in the future.
