In my very humble opinion the amendment was written that way in order to
allow the AB to remove an SC when the CC's are unable. As it stands now, the
AB is powerless. If a state's CC's are in fact stocked with the SC's cousins
and friends by only about 25% they can block the majority from removing
him/her. With the new amendment, the AB could take action even if the CC's
can not.
The problem with it is unjustifiable removal --as in the case of removing
the Gov in California by using a political process which was not intended
for that purpose, but was reserved as a remedy for criminal behavior or
treason.
I think the answer is to elect SCs for a two year period. Let them serve the
term unless they are no longer able to serve. Three years is much too long a
term.
My main concern is how long ASC's serve. There are states where the same ASC
has been there forever, even with different SC being elected. I think that
position should be limited to some reasonable time period.
