Beginning March 2nd, 2020 the Mailing Lists functionality on RootsWeb will be discontinued. Users will no longer be able to send outgoing emails or accept incoming emails. Additionally, administration tools will no longer be available to list administrators and mailing lists will be put into an archival state.
Administrators may save the emails in their list prior to March 2nd. After that, mailing list archives will remain available and searchable on RootsWeb

Well, first of all, they think that everything they do FOREVER belongs to
them. Screw U.S. Copyright laws, right? LOL They can scream and shout all
they want. If it is out of copyright, it is out of copyright.
Then there is the Fair Use Doctrine. That allows someone to "quote"
material up to 5% of their document. Now, that is generally used in a document,
but you then actually say where you got it from. Why don't you do a search
on the web and see if you can find some "Fair Use Doctrine" language that you
can quote back to them if you give someone some information from a
document.
However, violation of copyright, no matter how late the material was
created, your violation has to preclude them from earning money from something
they created. Now, chances are that someone who you give a couple of pieces of
information from some document are probably not going to go out and buy
that document. They will try to find that information some other way. So,
unless you are infringing on their right to earn income from something, they
have no real legal standing. Get me? LOL
I've used that scanning trick also. I know what you mean. And I wish I
had the time to just sit down and type stuff for a web page, cause I can type
like a house-a-fire also. LOL

Tell me about the societies. I once did a look-up from a transcription I
bought from a genie society on a mailing list. The gal raised so much heck
with me that I was waiting for them to come and get me and carry me away in
chains. LOL
So - okay, as soon as I manage to type up all these Civil War guys for
Middlesex Co., will begin on your Bergen Cems. There are five of them done
from 1910 - 1914.
Middlesex Co. Civil War was driving me nutz with 12 and a half pages of the
worlds smallest type. I finally started scanning it so I could view and
type it from larger print. Hopefully, I will get that done in the next week
and move on.
Yeah - I type it all so that it will be searchable on the website, plus, I
type like crazy when frustrated. I can't hone in on doing a webpage, but, I
can sure type like crazy then. One of those no-brainer things. So, tick
me off and put on as little Bob Seger, John Mellencamp or Peter Gabriel
I'll type anything in sight. LOL

So you think that it's okay to do that? If I were to type this stuff up, I
didn't plan to put it on my website, but send it on as a text file to the
counties where the info belongs. I just have a ton of NJ stuff as I have
some heavy duty roots there, but a lot of it isn't in Middlesex Co.

I am on the Atlantic side in Boca Raton. We are south of West Palm Beach
about 45 minutes and north of Fort Lauderdale about 30 minutes.
We are actually way out in West Boca Raton almost to the Everglades! We
have lots of gators and other critters even though it is a really home based
community. Lots of man-made lakes and canals. Hundreds and hundreds of
iguanas lay out in the grass along the canals around 9 in the morning, sunning
themselves. Some of them are huge!

U.S. copyright law for these type of materials goes back to 1923. So,
since they are older, I would just type them up and put them in your own
context, give credit as to where they come from and put them online. They are out
of copyright from what you have in your hands.
I have the same type of think for the state of Maryland. Just haven't had
time to work on them. LOL
I'd say go for it. The 1882 is definitely out of copyright. Now, if you
were working from a reprint by a society of an 1882 book, then they may have
added some things to the book and sometimes that is difficult to tell. But
if you are using an 1882 book, you are fine.
Current materials such obits in the newspapers, etc., are all copyrighted
by the newspaper. However, the facts included are not copyrightable and can
be extracted. So, the date of the newspaper, the name of the individual,
the name of the newspaper and other names, and dates can be extracted. No one
can copyright facts. It is the formation of that material into specific
text that includes someone writing it, no matter how mundane it is, that is
copyrighted.
So, you can extract names, dates, places.... and not get into trouble.
They may not like it, but tough. The law is the law. LOL

Oh, I still need to send you that magainze. Money has been a bit tight,
but am hoping that will ease up soon. LOL send me your address again, and as
soon as I can dig that magazine back out, I'll ship it off to you. I think
I picked it up at a major genealogy conference. Not sure if you can use
it, but you are the firsts person I thought of when I realized it was

That's because you aren't far enough south!!!!!! I think the lowest it has
gottne here in Boca is 48 or 49! Brrr...... That is definitely furnace
weather. I think we had 2 of those days last winter. However, from October
through January or Febuary I had the air conditioner off and only a couple
heating nights! Wahoo!
I certainly hope starting soon I can turn the darn air conditioner off!
Need to conserve money and this house is bigger and 2 story, so harder to
cool! But it's much better than living in the old truck! LOL
