is operating a probable scam through your server. They offer, for a
one-time fee of $49.95, the opportunity to view links of existing
copyrighted sites. Their scheme to operate within frames allows the
masking of sites, leading the user to believe that familydiscovery is the
owner of these links.
We are currently investigating them and contemplate pursuing legal action
if they do not de-link sites which are copyrighted by the NCGenWeb. Other
member affiliates of the USGenWeb are contemplating the same action. Be
advised that they have been sent a "cease and desist" order to which they
failed to respond. They have been terminated by their former host server,
www.Verio.com for violation of provider policies, similar to yours.
I am writing this to make you aware of the copyright infringement and
possible fraudulent use of your server by this organization. It would seem
that your acceptable use policy, as outlined at
http://bluehill.com/servers/contract.htm prohibits
www.familydiscovery.com
from operating in the manner I have described. Your clause relating to
Intellectual Property (see 6 & 7, below) has been grossly violated by
www.familydiscovery.com. Based upon this, we respectfully request that you
terminate their connection with your facilities.
