Greetings,
Thanks Ron for reminding me of some factual misstatements and omissions
about the registration(s) of the NCGenWeb Project.
1. "Ownership" of the NCGenWeb Project rests with the USGenWeb Project and
not the individual NCGenWeb Members as I previously stated. Reference
USGenWeb Project bylaws as follows:
ARTICLE I. NAME
The name of this organization shall be "The USGenWeb Project." The name,
"The USGenWeb Project," and "The XXGenWeb Project" (where XX is the
two-letter postal code abbreviation for each state) are service marks and
reserved exclusively for The USGenWeb Project and any websites representing
The USGenWeb Project.
2. The USGenWeb Project has a filing in process with the U.S. Patent Office
to register the USGenWeb and XXGenWeb projects as a service mark.
3. Advice and counsel for registration of the NCGenWeb Project was obtained
from the NC and AB that it was, to the best of my recollection, an SC
responsibility to register the project name with applicable state agencies.
4. Considerable "public" discussion of the issue transpired on the discuss
list. Among the issues discussed was the decision of the TNGenWeb to
incorporate and if the NCGenWeb should do the same. The full discussion is
available on the NCGENWEB-L and NCGENWEB-DISCUSS-L Archives.
Regards,
Paul
