Now comes Mrs. Iona Vinson, surviving Widow in community of M. A. Vinson,
deceased and avers that W. J. Vinson has applied to the appointed administrator
of the succession of M. A. Vinson. Petitioner avers that as surviving widow and
partner in community, she has a right of preference to administer the community
property. Avers that all the property made and created since the Tenth day of
April 1898, the date when petitioner married said M. A. Vinson, belongs to the
community of acquits and gains. Avers that said M. A. Vinson owned a farm prior
to her marriage to him, which belongs to the community between him and a former
deceased wife, but that the rents and revenues of said plantation and the
improvements and amelioration's made thereon during the existence of the
community belongs to the community between petitioner and her deceased husband.
Avers that eighteen bales of cotton, three hundred bushels of corn, ten tons of
cotton seed, the increase of hogs and cattle since her marriage, also that one
buggy acquired since her marriage to petitioner belongs to the community between
them; also certain household goods including a rocking chair, acquired since the
community belongs to the community.
Petitioner represents and avers that she is entitled to administer and control
said community property and entitled to the use of such thereof during
widowhood. Avers that said M. A. Vinson left no debts whatever and that there is
no necessity for an administrator.
Wherefore, petitioner prays that the application of W. J. Vinson be rejected in
so far as relates to the community property acquired by M. A. Vinson subsequent
to the tenth of April 1898 and belonging to the community existing between
petitioner and said M. A. Vinson. Prays that said community property may be
inventoried and appraised separately, and that petitioners right as surviving
widow in community to hold, possess and administer said property as
usufructuary, be recognized, adjudged and decreed by the court; and all of said
community property be ordered turned over to petitioner as usufructuary and that
the community have judgment against the separate estate of M. A. Vinson for the
amount that said separate property has been enhanced in value by said community,
to wit the sum of Three hundred and fifty dollars. She further prays for all
necessary orders and decrees and for general relief

Inventory and Appraisement

Be it known, that on this the fifth day of December A.D. 1899, in pursuance of
an order from the Honorable Fifth District Court in and for the said Parish,
dated November 17, 1899 and directed to me, R. A. Young, Clerk of the Fifth
District Court and Ex-Officio Notary Public in and for the said Parish,
requiring me to make an Inventory and Appraisement of all the property, real and
personal, rights and credits belonging to the Succession of Mack A. Vinson,
Deceased, lying and being in said Parish, I have in compliance with said order,
appointed J. R. Herron and A. J. McQuiller, Jr., appraisers to appraise said
property, who took and subscribed the following oath: "We and each of us do
solemnly swear that we will to the best of our ability and understanding,
appraise all the property belonging to and composing the succession of Mack A.
Vinson, Deceased, situate and being in the Parish of Ouachita, State of
Louisiana, which may be shown to us or come to our knowledge. So help us God."

And the said appraisers in the presence of Robt J. Willson and legal and
competent witnesses, and with me said Clerk and Ex-Officio Notary Public
proceeded to make said Inventory and appraisement as follows, to-wit:
"A certain tract of land lying and being situated in the Parish of Ouachita and
described as the E. ½ of the S.W. ¼, the S.E ¼, the S.E. ¼ of the N.E. ¼ of
Section No. 21, the S. ½ of the S.W. ¼ of Section No. 22 and the N.W. ¼ of the
N.W. ¼ of section No. 27, all in Township No. 18 North of Range Five (5) East,
in the North of Red River land District, being same property acquired by M.A.
Vinson by purchase from James A. Wallace, per deed on file and of record in
Conveyance book No. 31, page 95 of the records of Ouachita Parish Containing 400
acres more or less, with all improvements thereon,

Application and order Appointing Tutrix
To the Honorable Judge of the fifth district court in and for the Parish of
Ouachita, State of Louisiana:
The petition of Mrs. Iona Vinson respectfully represents that she is the
surviving spouse of M. A. Vinson, deceased, who died in your said Parish on the
13th of November, 1899; and that there is one child, offspring of the marriage
between petitioner and said M. A. Vinson, namely, John McIntosh Vinson, aged
about nine months, and that said minor child is one of the heirs of said M. A.
Vinson, who left an estate of real and personal property in your said Parish.
Petitioner avers that she desires to be confirmed as Natural Tutrix of said
minor, John McIntosh Vinson, in order to have said child's portion of said
estate turned over to petitioner to be administered by her according to law.
Wherefore, petitioner prays that an inventory of the estate of said minor be
made, that a certificate of said inventory be duly recorded, and that she be
duly qualified and confirmed as Natural Tutrix of said minor John McIntosh
Vinson, upon taking the oath required by law; and for general relief.

Order
By reason of the law and foregoing application being considered, let an
inventory of the estate of the minor, John McIntosh Vinson, be made, as prayed
for; and let certificate of said inventory be recorded, as prescribed by law,
and let Mrs. Iona Vinson be appointed and confirmed as Natural Tutrix of said
minor, upon taking the oath required by law.

pursuance of an order from the Honorable Fifth District. Court in and for the
said Parish and State, dated 22nd day of December 1899 I, R. A Young, Clerk
Fifth District Court in and for said Parish, proceed to make an Inventory and
Appraisement of all the property, real and personal belonging to the estate of
the minor John McIntosh Vinson, minor child of M. A. Vinson, deceased, and his
wife Mrs. Iona Vinson, situated in said Parish. I have in compliance with said
order appointed A. J. McQuiller, Jr. and John Sholars, appraisers to appraise
said property, who took and subscribed the following oath:
"We and each of us do solemnly swear that we will to the best of our ability and
understanding appraise all the property, real and personal belonging to and

And not knowing of any other property belonging to said minor, and none other
having been shown to us or otherwise coming to our knowledge, we have closed
this inventory and appraisement , amounting in the aggregate to the sum of FOUR
HUNDRED DOLLARS.
In faith whereof, said appraisers have hereunto signed their names in the
presence of the aforementioned witnesses and me said Clerk on this the 22nd day
of December A.D. 1899.

On Jan 5th W. J. Vinson withdrew his application as administrator of the estate
of M.A. Vinson in favor or Mrs. Iona Vinson, wife of the deceased.
Mrs. Iona Vinson was appointed Tutor and John Sholars as under tutor of the
Minor, John McIntosh Vinson on December 22, 1899 and he was awarded a 10th of
the Estate of M. A. Vinson. Then on Jan 15 1902 the Judge of the 6th District of
Ouachita Parish, L. E. Hall, approved the sale of his portion of the Plantation
for $400.00
To the Hon. the Judge of the Fifth District Court, within and for the Parish of
Ouachita and State of Louisiana: -
The Petition of William J. Vinson, a resident of your said Parish and State,
respectfully shows:
That he is the son and only child of the late M. A. Vinson by his first
marriage.
That his Father, M. A. Vinson, died on the 13th day of November, 1899, in your
said Parish and State, where he had lived all of his life.
That he was possessed of a considerable estate of both real and personal
property, at the time of his death, situated in the Parish of Ouachita.
That he owed little or no debts; that he left three children issue of his
second marriage with Amanda Adams, all minors; that he left a widow Iona Wilkes,
and one child, issue of his marriage with her; that some of his property was
acquired during his first marriage, and some during his second marriage, but
very little during his last marriage.
That his Estate consists now principally of a Plantation in your said Parish
and State, known as "The Wallace Place", which he has been cultivating for some
years, and was cultivating this year; that the affairs of the Plantation for the
current year are yet unsettled; the crop only partly gathered and unsold, and
that an inventory of his Estate, is, in the opinion of your Petitioner,
absolutely necessary to keep a record of its assets, and for the determination
and settlement of the various interests of himself and his co-heirs thereunder.
He, therefore, prays for an order for an Inventory of the Estate of the late M.
A. Vinson, deceased, and for the appointment of an Administrator of said estate,
after due notice has; and as he is the nearest male relative of age, that
Letters of Administration issue to him, upon complying with the law.
The foregoing Petition considered, it is ordered that the application of
William J. Vinson, to be appointed administrator of the Estate of M. A. Vinson
deceased, be advertised according to law; That an Inventory and Appraisement be
made by R. A. Young, Clerk.

The petition of Mrs. Iona Vinson tutrix of the minor John McIntosh Vinson
respectfully represents that it is necessary that an Under Tutor should be
appointed to represent said minor.
Wherefore she prays that an Under Tutor be appointed according to law and for
general relief.

Judgment
By reason of the law, it is ordered, adjudged and decreed that the Proceedings
and recommendations of the Family Meeting within set both be and the have all
hereby homologated and approved this and that the tutrix Mrs. Iona Vinson is
hereby authorized to sell the undivided one tenth interest of the minor John
McIntosh Vinson in the Wallace Place at private sale on the terms recommended by
the Family Meeting and effect a facilitation thereof. Done and signed in

Application and order for Family Meeting
To the Honorable Judge of the Sixth District in and for the Parish of Ouachita,
State of Louisiana.
The petition of Mrs. Iona Vinson tutrix of the minor John McIntosh Vinson
respectfully represents that her minor child owns a one tenth interest in the
Wallace Place situated in your said Parish and described as E 1/2 of S.W. 1/4,
S. E. 1/4, and S. E. 1/4 of N. E. 1/4 all of sect 21 and S 1/2 of S. W. 1/4 of
sect 22 and N. W. 1/4 of N. W. 1/4 of sect 27 all in Township 18 N. of R. 5 E
containing 400 acres of land with all the improvements thereon being same
property bought by the late M. A. Vinson, father of said minor, from James A.
Wallace on the 13 February 1890, as per deceased recorded in Notarial Book 31
pg. 95 terms of sale according to law and for general relief.

The foregoing petition having been considered and by reason of the law it is
ordered that a Family Meeting be convoked as prayed for to meet before R. A.
Young Clerk of the District Court of Ouachita Parish at his office in the City
of Monroe on the __th day of January 1902 at 10 o'clock a.m. there to consult,
deliberate and advise towards the sale of the interest of the minor John
McIntosh Vinson in the Wallace Plantation particulars described in the foregoing
petition in order and to effect a solution that said Family Meeting consist of
the following members:
Allen Sholars, A. J. McQuiller, Julius Lemle, R. W. Wren and A. J. Herron,
minors in default of relatives, friends of said and that said clerk return a
process verbal of their proceedings according to law. Done and signed in
chambers this 9th January 1902.

Petitioner represents that said minor's interests are so small that it is
impossible to administer it with benefit to said minors and that she as tutrix
of said minor denies to sell said property at private sale to one of the
co-owners or to any other purchaser in order to affect a partition according to
the provisions of Act No. 25 of 1878.
Wherefore petitioner prays that a Family Meeting be appointed and convoked by
your Honor and ordered to assemble before R. A. Young Clerk and Notary Public in
and for said Parish of Ouachita on a day to be fixed by your Honor there to
advise and consult with regards to the sale of interest of the minor John
McIntosh Vinson in the Wallace Plantation to appraise said interest and fix the

Be it remembered that on this the 15th day of January A.D. 1902, by virtue of
an order rendered on the 9th day of January A.D. 1902, and to me directed, I
caused to be convoked and assembled at my office in the city of Monroe, La. at
the hour of 10 O'clock A.M. January 15th 1902, the following persons, designated
in said order, friends in default of relatives of the above named minor, to-wit:
Allan Sholars, A. J. McQuiller, Julius Lemle, R. W. Wood and A. J. Herring,
friends of said minor, and thereupon each and every one of said members of said
family meeting having taken and subscribed the following oath, to-wit:
"We and each of us do solemnly swear that we will well and truly advise
according to the best of our understanding, touching the best interest of the
minor, John McIntosh Vinson, upon all such matters as may be presented to us for
our deliberation. So help us God."

I proceeded to lay before them the petition of the tutrix containing a
statement of the matters upon which they were to deliberate, the said petition
being hereto annexed and made a part thereof, the said Under Tutor of said minor
being present during the deliberations of the said family meeting and advising
and concurring therein. Whereupon said family meeting proceeded to deliberate
upon the said matter, and having fully considered the same, advise that the land
described in said petition, be sold at private sale under the provisions of Act
No. 25 of 1878: and their reason for said advice, is that they are satisfied
that said property cannot be administered with benefit to aid minor, and that it
can be sold at private sale advantageously, to effect a partition of said
property, they further fix the full value of the minor's one tenth interest in
the property described at $300.00, and they recommend that the minor's interest
in said property be sold at private sale for $300.00 cash, provided that amount
can be obtained. In faith whereof, the said members of the said family meeting
have hereunto signed their names with me said Clerk and the attesting witnesses
on this 15th day of January A.D. 1902.
