Columbia City, Indiana October 9, 1844 - I, Benona Mosher, of Columbia in the State of
Indiana, do make and publish this my last will and testament, hereby revoking and making
void all former wills by me at any time heretofore made. I direct first that all my just
debts and funeral expenses be paid as soon after my decease as possible, out of the moneys
that shall come to the hands of my executors, from any portion of my personal estate. I
also direct that a fine valuation or appraisement be made by three judicious neighbors of
all my said estate, including my household furniture and after being signed with their
names, that a copy of the same be given by them to each of my executors and to effectuate
this my intention. I hereby vest my executors withfull power and authority to dispose of
my personal property so far as to consumate my just and honest debts. I also further
direct that my real estate above paying the aforesaid debts be equally divided share and
share alik!
e between my beloved wife, Cynthis (sic) Mosher and my two eldest sons, William and Hiram
Mosher, and I further direct that William and Hiram Mosher shall share and share alike in
one third of my personal property and I further direct that my other three children,
Francis Lorza and Sylvia and Warren Mosher shall share alike in the other third and the
other third to my wife, Cynthia Mosher. And I further direct that my wife, Cynthia Mosher
shall have her support out of the whole property as long as she shall live and I further
declare and direct that the share of my real estate thus bequeathed to my said wife, shall
after her decease fall to my three youngest children, Francis Lorza and Sylvia Ann and
Warren Mosher and I Hereby make and ordain my worthy and esteemed friends and wife,

the presence of us who have hereunto subscribed our names as witnesses thereunto in the
presence of each other Levi Mosher (Seal) John W. Mosher (Seal) In the matter of the
Probate of the Will of Benona Mosher - In the Whitley Probate Court, November term A.D.
1844 Levi Mosher being duly sworn on his oath saith that he is one of the subscribing
witnesses to the will of said Benona Mosher that at the execution thereof the said Benona
was in sound mind and was of full age that this deponent subscribed the same in the
presence of the said testator at his request that Sarah Pierce signed the name of the said
Benona Mosher and at the request of the said Benona Mosher and further that the said
testator in his presence a!
nd hearing declared that he made declared and published that as his last will and
testament thereby revoking all former wills by him made and further saith Levi Mosher
State of Indiana Whitley County I, Richard Collins, Clerk of the Whitley Probate Court,
do certify that Levi Mosher personally appeared in open court and was duly sworn that the
evidence was written by me or under my direction that the same was signed by said witness
