A closed probate file means one that was completely settled with the final
accounting provided to the court and disbursement to all heirs and
creditors. It could be that something was filed in Vigo County. If you
have been able to find your grandfather's grandfather then you might also
see if the FHC has copied the probate records of that county.

As for the estate's location, to which grandfather was a probable heir, I
don't know the location. Because the ancestor's names that are listed in
the
power of attorney (when compared to the affidavit), as possible unsettled
estates, goes quite a-ways back, I really doubt they were located in Vigo
County. Several Ancestors are named but the last one named seems to be the
focus and this one would have been my grandfather's 4th great
grandparents.
So far I have managed to research back to my grandfather's grandfather
(born
1820), which was in IL.
As you can well imagine, if I could get good copies of the original papers
(including those documents he provided as proof of genealogy), well.....
words just can't express how exciting it would be!
Do you know if these papers would have been filed in Vigo Co., IN even if
the estate was located some where else? At the risk of sounding
foolish....What is a closed probate file?

If your grandfather used these to prove that he was a legal heir then
these
would be in the probate records. If the estate to which he was a
prob
able
heir was also in Vigo county you can look there. Each probate order
book
has an index and each probate file is also indexed. There are also
minute
books which contain the actual clerk notes but usually these are
really
hard to locate. Check first under your grandfather's name. Look for any
other individuals with the same surname. Especially open files (not
closed
probate files).

Sorry about such a generic subject title.
I am hoping to find out what happens to Affidavits & Power of Attorneys
and
notary publics records in Vigo County, IN.
I'll try to briefly explain:
My grandfather in 1932 had an affidavit drawn up & signed by him that
stated
he was the son of.......that his father was the son of...... This goes
back
about 8 generations listing father & mother's name each
generation! Along
with these papers was a Power of Attorney naming a Thomas A. E. Cantwell
as
grandfather's true and lawful attorney. (I'm not sure if this man was
actually an attorney or just a notary public, but the power of attorney
reads like an actual attorney was involved:...the above named will pay me
25% of the net value.....this power of attorney to be valid and
irrevocable
for such length of time, as the nature of the case may
require.......)
Among these papers also states that grandfather has provided his
genealogy
as true as he is able to determine from family bible, public library
records, cemetery records & inscriptions on tombstones and bureau of
public
records which are attached here to.
Isn't that GREAT! I'm sure everyone is thinking. Yes, it is but please
read
on.
As best as we can determine (guess) grandfather must have been contacted
in
some way and told that he might be entitled to an inheritance of one
of
his
ancestors estates. As there is no-way he would have known these
ancestors
so
far back. Not to mention his own father & mother (as best as we can tell
so
far) died when he was about 7-9 years old and was taken in by a
non-relative, this was in IL. This family has been very hard to research
because grandfather's descendants know so very little about grandfather's
family.
The copies I have of the Affidavit & Power of Attorney are copies of a
copy
and the original must have been in bad shape. No one in the family
has
any
original or copies of that information grandfather provided as proof
of
his
genealogy.
I'm sorry this took so long.... My questions:
In Vigo County, IN would these kind of papers/documents/records be held
somewhere?
Would the Affidavit, Power of Attorney, and those attached proof of
genealogy (which of course is what I'd most like to get a look at!) be
recorded/filed in the courthouse or somewhere? If so, where, what and how
do
I go about getting to them (& hopefully get copies!) "get my hands on
them"?
