Last will and testament of James McCartney
Box 2, Record 2, Page 95
Dept. of Records Management and Archives
South Bend, St. Joseph, Ind.
In his will filed 6 Jun 1862, James McCartney divides his land between his sons Benjamin
F, Edd, Charles F and Delbert McCartney. They are each to receive their portion upon
turning 21years old. The spelling of Delbert's name is not clear -- looks like
Delvert.
Lands are located in Sec. 35 Township: 38 North Range 2 East along the St. Joseph River
and Sec. 26 Township: 38 North Range 2 East
He also provides funds to support his "beloved" wife. [Louisa (Clark)
McCartney] She is to have all the profits of the land until each son shall reach the age
of 21. She also receives all of James' personal property. In an attached statement,
dated 12 July 1862, Louisa McCartney put her "mark" on a document accepting the
terms of the will. That document is witnessed by Louisa's brother E.V. Clark, clerk of
the Court of Common Pleas.
James McCartney's will names Thomas Stanfield as executor.
Signed: James McCartney 1 Feb 1862
Witnesses are: Garret Crockett, Joshua M Price and Thomas Stanfield.
Admitted to Probate on 6 Jun 1862 by E.V. Clark, Clerk of the Court of Common Pleas, St.
Joseph Co.
[Ages of James McCartney's known children at his death in 1862

[Louisa states in 1900 Census that she was the mother of seven children, with only one
surviving. That would be her son Charles F McCartney, who appears to have been handicapped
or disabled.]
