The jury in the case of Ellen Hatch et al. vs. Mary Hill, contesting the validity of
the will of the late Daniel Hill, of Elkhart county, returned a verdict Friday in favor of
the plaintiff, after being out 24 hours. Judge John Vanfleet, or counsel for the defense,
immediately gave notice of the filing of a motion for a new trial. The case is likely to
go to the supreme court.
As the jury could not get together before noon the norning session of the St. Joseph
circuit court was brief Monday. It took just 20 minutes to bring the docket up to the
jury, and court then adjourned until 1:15 p. m.
In Menges vs. Menges, claim, Mr. Funk gave notice of a motion for a new trial on the
ground of excessive damages, not sustained by the evidence.
