If the statue says the records are open then the local government agency has
no legal right to deny you access to them. Since you are having troubling
accessing the records I would contact the Public Access Counselor about the
situation. The whole purpose of the office is to provide information and
help regarding access to government records and meetings. Their website can
be found at
http://www.in.gov/pac/ They can provide informal responses to
questions. Also there is a formal complaint process.

Birth and Death records are a precious commodity in Randolph County. They
guard them well, and say it is for protection against identity theft.

that is just a cop out in my book, (just my opinion - I am just a little
bit
frustrated with the whole situation, if you can't tell) the State Health
Dept told me that as long as the records are over 75 years old there is no
problem with having access. They said it is hard to try and pass yourself
off as a 70 year old and that most identity theft victims are younger. If
the State Health Dept doesn't see a problem then why does the county????
Anyways, I contacted the State Health Dept a few years ago about making an
index for the website. They told me their index only contained the name of
the deceased, the county and year. I am thinking they said it doesn't have
a
complete date???
They recommended that I use the County books to make an index because they
contained more information, which as most of you know by now, I was denied
access. :(
