In the continued debate of our new legislation, one individual has
pointed out the following, paraphrased:
"Even though 23-14-68 would seem to remove the burden of responsibility
from the shoulders of the township trustees for those cemeteries on
private ground, 23-14-74 would place that responsibility squarely on the
shoulders of the landowners"
Not so says I, Upon closer examination of the chapters in question,
23-14-74 has played a clever game of semantics with chapter 68. The
inclusion of the adjective "public" to describe it's cemeteries has very
successfully isolated chapter 74 from chapter 68, which very obviously
lacks the use of the word public. It is also prudent to point out that
in the definitions to this article, the word "public" nor the phrase
"public cemetery" are defined, leaving the proper definition strictly a
matter of generally accepted use. The sum effect of this whole thing is
to leave a gaping loop-hole in the law, through which our pioneer
cemeteries will surely fall.
