In your situation, a key element may be WHEN the developers plan to break
ground. If it's after 7/1/2000, PL46 may be of use to you. You might want to
consider keeping mum for now if they aren't going to be disturbing the ground
for a couple of months as the approval process continues; then, on 7/1/2000,
you can spring PL46 on them.
Have you been in contact with the DNR? What reaction/response did you
receive?
Someone you might want to contact is State Rep. Markt Lytle <see
http://www.state.in.us/R69 for contact info>. He is the Chair of the House
Agriculture, Natural Resources and Rural Development Committee of the House of
Representatives. Rep. Lytle has been very concerned about situations just
like this and HB 1184 (which he sponsored) was intended to address these
scenarios.
Do you have a County Cemetery Commission there? Have you been in contact with
the various historical/genealogical societies in the area?

Subject: [INPCRP] GDR Survey on Lewellen Cemetery
After seeing the plans that will go before the Plan Commission May
3rd for
Shadowcreek Farms subdivision the other day, I go a little worried they had
dismissed the evidence of a cemetery, so I called the archeologist they
hired. He said they agreed to 2- 1 acre surveys using the special
equipment. One in the center where the scar showed up on the aerials and
one where the fence line used to be. He said if everything went alright,
they would be doing it Thursday. The subdivision is going to have it's
problems getting approved as they are about 40 ft. lots. I'd like to take
off and be there when they do it, but I don't know if I will be able
to. Donna Kuhlman who works on the cemeteries here is going to call him
again tomorrow to pinpoint a time. She will be there as well as at the
Plan Commission meeting to make sure the Commission is told about the
possible cemetery.
Is there anything else that should be done? Anyone else that should be
alerted as to what is going on or is it too early for that? Should someone
from the your group at the state level be there? Donna said she thought
that other local cemeteries would be interested in how efficient the
outcome of the survey turns out to be vs. the cost of it.
Also, if they find what appear to be graves or even just a grave, what do
the HAVE to do?
Any suggestions?
