Kyle,
We have the problem here of little or no care and in light of that, formed a
cemetery association some years ago to invest funds from which only the
interest would be used to assist the town in regular maintenance. That fund
coughs up about $3000-3500 annually to help but when big things come along,
it takes a special fund raiser to find the money (and that doesn't always
bring in enough). Using the principal on occasion would be fine if one could
guarantee that people of integrity will be on the governing board, but alas,
not so. Several of our city council members did everything they could to
break into the fund several years ago, but luckily, the state protects those
funds. The problem with using those investment dollars for daily things is
that once spent, the money is gone forever and a bigger problem might come
up next year. When just the interest is used, there'll be more next year
(and if interest rates ever come back up, maybe it will be more than enough
to sneeze at.)
Our cemetery lots currently cost $350 for one adult lot. Opening and closing
is another $300. the cemetery is owned by the town which does give minimal
care. I would like to see the town raise the price another $50 which would
go into that fund for care.
What do cemetery lots cost elsewhere?

If we push the issue of
the perpetual care to the extent of the law, many of us, and I mean
us as
those
on this list that sit on cemetery associations, could easily be in
violation
as we are currently using the principle to operate our cemetery.
The
alternative would be to drastically increase the cost of burial lots
and/or allow
less
maintenance to occur due to the money being tied up and
unavailable.> Kyle
