It's all legal. The stones inside the fence were moved there many years ago
to facilitate mowing. I assume the stones leaning against the fence are
more that were found during digging. That is they found stones that had
fallen in been covered by dirt many years ago.
They thought there were 100 burials in the cemetery, because the church had
a list of 100 names. Before the digging was started, they identified 800
grave sites in the area. They are supposed to be moving the graves closest
to the road to blank spots in the cemetery. Of course, those dug up will be
examined before they are reburied. The University of Indianapolis is in
charge of the examining of the remains.

My son lives down there and showed me a small area on the top of a hill,
with a wrought iron fence, a small cemetery, and they are digging all
around
it and there are many many more stones leaning up against the iron gate
now,
he lives there and has watched this. They appear to be really digging up
the surrounding area of where the cemetery is. there are definitely more
stones leaning in the enclosed wrought iron area then will hold. Does
anyone
know what is going on there?????? And is this legal????
