Cris, The 2 mile area you refer to is the "Fringe " area around a city,
expressly for the purpose of controlling the Land Use, so it will conform
with the intent and purposes of future development near the city. If they
have not Legally "Annexed" the area, then it is not a part of the city, under
Indiana Law they merely have control of the Land use in the future for this
area, and they have not assumed the control of the cemetery, nor the
ownership, only usage in the future if changes are made in the cemetery, such
as enlargement, or configurement, will it then come under their control. Any
changes would have to be approved by the city of Columbus. The Cemetery
should still be under the Control of the present Twp. Trustee. NOTE, This
is only an interpretation of the fringe Law. NOT a Legal Opinion of
ownership, or Jurisdiction. I hope this helps, someone else may have a
