Several people have contacted me recently asking for a "Permission Slip" for
doing cemetery clean-up and restoration.
Every situation is different, which makes designing any sort of "standard"
form difficult. However, for projects done IN CONJUNCTION WITH THE TOWNSHIP
TRUSTEE on cemeteries for which the Trustee is responsible pursuant to Indiana
Code 23-14-68 <
http://www.ai.org/legislative/ic/code/title23/ar14/ch68.html>,
one could customize the sample Permission Slip found at
http://www.rootsweb.com/~inpcrp/PermissionSlip.PDF. (The free Adobe Acrobat
READER must be installed on your
system in order to access this PDF file and it is available from
http://www.adobe.com/products/acrobat/readstep2.html.)
A caveat, however: The INPCRP does not represent that this SAMPLE Permission
Slip is "legal and binding". We are NOT attorneys. We do believe that the
sample addresses several important issues but if you are concerned about
liability which might arise as a result of clean-up or restoration work, then
we urge you to consult competent legal counsel before initiating such a
project. The risk of injury to persons or property is very legitimate. This
can be dangerous work and should not be entered into without considering these
potential consequences.
If you have suggestions on language that should be changed or added, we hope
you'll discuss it here on the list so we can possibly incorporate them. We
want to keep it short and simple, but hope to make it useful.
One important aspect of this sample form is that, if one were doing clean-up
work at a site -- in conjunction with the Township Trustee -- and were
approached by a DNR Conservation Officer or other law enforcement authority, a
permission slip such as this would evidence that the Township Trustee had
given his/her permission for the work to be conducted.
We welcome your thoughts on this subject.
