Hello All,
There is no law or code that says the city now has to maintain it. I am
assumimg here that Liberty is an abandoned or defunct cemetery, with no
owner. In that case, it is the responsibility of the trustee regardless of
whether it is in or out of town/city.
If it is still an active cemetery, you can petition the legislative body
(City Council) to maintain it. This requires:
1. 10% of the freeholders and taxpayers (read propertowners) to sign
a petition.
2. The cemetery lies within 1/2 mile of the corporate limits of the city/town.
3. It is in need of additional care & maintenance.
4. At least 25% of the burial lots are owned, maintained, and cared for by
freeholders in the city or town.
See IC 23-14-66-1 for the complete code. IC 23-14-67 and 68 deal with the
care of abandoned cemeteries by Counties and Townships.

the Flatrock Twp Trustee. They even formed a group, Friends of Liberty,
to fix it up about 3 years ago. It has had a lot of vandalism in the past
so since they worked on it, it has been kept locked. Since it is now
officially within the City of Columbus, what does this mean for the
Trustee who has to maintain it. She is trying to find some law or code
that says it has to now be maintained at the expense of the city.
Anyone have any ideas?
