They approved the permit. BUT, they lost all lots on a grade steeper

curbs.John said the Board gave them approval, but in winning they lost a

of lots. And they have to go back to the drawing board and basically start
over. Aquascorce has not agreed to build a sewer plant. It will not be
approved until the location of the sewer plant is approved with all permits
(Fedral,State, County. They also have to submit an enviromental impact
statement. there is more but i can't remember it all. NOW the bad news,
they
have to file an impact statement, and their plans to the DNR. (If they will
take it.) Get a permit from the IDOH. Then get a court order. Now if they
move the cemetery first, then they techniaclly can' build within 100 ft on
either of the 3 sides on their property according to the law. If the "New
cemetery is 20 X 30 in the corner by David's house they loose 100 ft each
side and 20 ft for the cemetery, in effect they will loose 2 more lots.
The
Plat map shows 2 lots abuting the Cemetery, NO, NO, David also said if
they
put it against his property, he cant build within 100 ft on his property,
effictively causing monetary damage to him ,by depriving him of the use of
his property. If the developer comes back he might end up leaving the
Cemetery where it is. We will have to keep in touch with the lawyer.l Also
am going to contact the DNR officer in Floyd Co. tommorow or Wed. and show
him a copy of the Indiana Code, for 2000. It seems the board was not aware
of
the law you quoted them. You were gone, but the president refered to the
Cemetery 4 more times. We probably lost but we made them squirm. They will
have to follow the Law. They thought Dr. Bickers was enough. The Board said
not quiet. Wanted to let you know while I remembered, John said the board
ok'd enough that they cant sue them.
