Jack is exactly right!
The way this amendment is written, if passed, will place the
responsibility of surveying, and applying for state registration of a
cemetery, squarely on the shoulders of the land owner. Conventional
survey by a state certified land surveyor could cost many hundreds of
dollars particularly since many of these sites are way off the beaten
path and may require brush and under story removal for line-of-sight
with the surveying equipment. Hard to imagine what incentive the
property owner has to pay for these expenses?
Seems to me that if this bill passes far fewer early pioneer cemeteries
will be recorded with the state and more will ultimately be destroyed.
This language has the distinct odor of special interest lobby and
bureaucratic indifference to cemetery preservation.
Anybody know when the hearings (if any) will be held? There are several
arguments that should be made before this one gets by. Keep me posted
and count me among the nays.

Subject: [INPCRP] HB 1758 (Yes or No) It's that simple
To the List, If you have read the new House Bill, (1758) and you
think the
landowners are going to accept it, let it be known. If you think
they
wont
accept it, or participate, let that be known also, remember we should
let our
opinions, and the opinions of the Landowners be KNOWN. I recorded 3
cemeteries (Burial Grounds) today, the largest 30 X 30, and I told the
Landowners afterwards about the new Bill, and all three said no
thanks. But
for every three that says no maybe 300 would say yes. We of the
INPCRP need
to know, these laws affect us all, and we should be able to explain,
to the
best of our ability, all of the applicable Cemetery Laws as we know
them when
we approach the Landowners. It is a responsibility we accept when we
ask them
for permission to go on their land to Rescue a Burial site. In Floyd
Co.
Ind. we may have 15 or 20 large Cemeteries, the rest are Family
Burial
Plots,
scattered through the Fields and woods. We have a known total of
approximately 120, and we are the 3rd. smallest county in the State.
Here
they wont sit aside an acre of Ground for a 30 X 30 plot of Ground.
We
don't
have that much. If you are in favor of the new Bill, say, Aye; if
opposed
say No; I never even heard about a hearing, of course that's my
fault.
I Know
how to find out. The Legislature wont know, if we don't say
anything.
I
will now be silent on HBO 1758 (No more except to respond)
