In regards to fencing, section 68 is titled Care of Cemeteries by Townships;
Section 1 defines the cemeteries covered -- using the current Pioneer
Cemetery definition. Seems pretty clear to me.
As for us not being attorneys, neither are the majority of people who write
state law. Unlike Washington legislators, I'd say an attorney in the State
House or Senate is the exception.
The Trustees I've worked with are aware of the law; but they also know they
don't have the funds to do it and that the law is not enforced any more than
the repair of monuments clause. Dick Shirey, the current trustee of Center
Township(city of Muncie) went so far as to tell me that our committee should
bring criminal charges against any Trustee who refused to work with us.
Mark Davis is doing the restoration at the Old Winchester Cemetery...at
least the first stage; he can fill us in on the completion, I'm not sure.
