Hello again Mary Lou,
I think you might be on to something this time. I do not have the complete
probate record for Henry Dougherty, but I do have the filing of the letter
of administration.
This record is on file in the Clerk's Office, Orange County, Indiana,
Probate Order Book 2, Nov. 1838 thru Nov 1846, page 590:
"IN VACATION
Be it remembered that letters of administration on the estate of HENRY
DOUGHERTY late of Orange County deceased was granted to CYNTHA DOUGHERTY,
she having given bond as required by law in the sum of five hundred dollars.
JAMES SMITH and MICHAEL DOUGHERTY as her securities and qualified.
Test: Jeremiah Wilson
Monday, August 24th 1846
Ordered by the court that the grant of administration made by the clerk of
said court during vacation to wit: to CYNTHIA DOUGHERTY, letters of
administration upon the estate of HENRY DOUGHERTY deceased by and the same
are hereby confirmed."
I know you're looking for the parents of Spicy Jane Dougherty who married
James T. Smith. It's at least an interesting coincidence to see the name,
James Smith, in the above document.
William C. Stewart reported in "The Doughertys of Kentucky", that Henry
Dougherty, born 1784 in Kentucky married Cynthia ---- (unknown) from South
(North?) Carolina in Indiana about 1810 and died in Orange County, Ind., BY
Nov. 14, 1846. (Henry Dougherty being the son of Capt. John Dougherty and
Isabella Anna Allen or Patton.)
In the 1850 census:
French Lick twp., Orange Co., Indiana
Dwelling #887, Family #891
Cyntha Daugherty, age 58 (b. abt 1792), born S. C.
Mary F. Daugherty, age 20 (b. abt 1830), born Ind.
Maria Daugherty, age 15 (b. abt 1835), born Ind.
Cyntha Daugherty is the head of the household and appears to be a widow in
1850. Mary and Maria are the only children with Cyntha in 1850. The rest
of the probate record for Henry Dougherty should name all heirs. There
might also be deeds in Orange County, IN issued after the death of Henry
Dougherty naming heirs. I'd be glad to look on my next trip to Orange
county, but it might be another month before I get there.
I do not know why Henry Dougherty's wife's name was ever reported as
Catherine. That appears to be incorrect. At the time of his death, Henry
Dougherty's wife was Cyntha (or Cynthia).
Debra Dougherty
