Richard L. Newman Thus Refers To The Family of a Dead Daughter
HE FORGOT TWO OF THEM
George D. Searing, Senior, Executor of His Estate
In making his will, which bears the date of September 17, 1897, Richard L. Newman, who
died recently, omitted two grandchildren, the children of his dead daughter, Arlinda
Rinehart; from the list of beneficiaries.
This was an unintentional omission and in a codicil bearing date of November 9, 1905,he
interentially charged "the scrivener of my will" with the oversight and refers
to the eight grandchildren, the children of his dead daughter, as a "Roosevelt
family. "
In his original will Mr. Newman left one hundred and thirty-one acres to his son
Rozaine H. Newman.
He left one hundred and eighty acres to his son, Delmar Newman.
He left one hundred and forty acres to his son , Charles R. Newman.
Against the land left to his sons, Delmar and Charles R. Newman,he made a charge of
four hundred dollars, two hundred dollars each, to be paid within one year from his death
to his executors to be by them turned into a fund which was to be paid to six
grandchildren he named, the children of his dead daughter, Arlinda Rinehart, their names
being Charles, Orpha, Mary, William, Clara and Simon. Each of these grandchildren is to
receive three hundred dollars, four hundred of which is to come from Delmar and Charles R.
Newman, their uncles, and the remainder from the sale of forty acres of land in Mason
county, Michigan, where their parents lived and where their mother died. In his codicil of
November 9, 1905, Mr. Newman added the two grandchildren omitted and therein he made
reference to the " Roosevelt family. " Each of the grandchildren is to receive
his or her share of three hundred dollars upon reaching twenty-one years of age.
This will was signed by John Smith and James C. Devinney, as witnesses.
Another provision made in the codicil of 1905 is that of changing the title of the land
left to Charles R. Newman from fee simple to a life estate, his children to be the final
heirs.
Another and the last codicil, bearing date of February 21, 1910, relieves Rozaine H.
and Delmar Newman, two sons, of the responsibility as executors, and names George D.
Searing, senior, of Howe, as their successor to be in charge of the settlement of the
estate.
Laora M. Rowe and Otis L. Ballou signed the two codicils as the witnesses.
From the personal property of the estate all debts are to be paid, including burial,
and the residue is to be divided in thirds to the three sons, Rozaine H. , Delmar and
Charles R. Newman.
Judge Ballou was the writer of the will and had it in his possession at the time of
death of Mr. Newman. Judge Ballou, after the death of Mr. Newman, filed the will with
County Clerk Troxel for probate. Some objection to the probate has been made, by one of
the interested persons, but whether or not the objection will be withdrawn is not now
known.
