This is the will of James Anderson, probated December Session, Yancey Co., NC,

December Session 18
An Instrument of writing perporting to be the last will and testament of
James Adisson (sic) dec'd was produced in open Court & admitted to probate
upon the Testimoy of one of the Subscribeing witnesses Dorcas B. Anderson who
swears that she saw the said Jas. Andieson assign & acknowledge the same &
that she assigned it as a witness in the presents of him the said Jas.
Anderson dec'd and in the presents of other subscribeing witnesses the will
in the following words & figures to wit
Know all men by these presents that I James Anderson Senior of the County of
Yancey & State of Northcarolina being sick of Body & weak of mind but of
perfect mind and memory & calling to mind the mortality of the Body &
knoweing that it is appointed for all men once to die do make this & no other
my Last will and testament (towit) first and principally I give my soul in
to the hands of the almighty God that give it to me & my body to the Earth
from whece it came to be buried in a decent form at the discretion of my
Executors here after mentioned not doubting but I shal receive the same at
the General Resurrection of the same almighty power and also as touching said
worldly goods or Estate where with it hath pleased god to bless me with I
give & dispose in manner & form following that is to say first I give &
bequeath to Francis Aderson my dear & beloved wife all and singular thing or
things that to me or in any wise belonging to me (viz)
All my Landed Estate that I possess in the said county of Yancey to gether
with all my Horses Cattle Shep and Hogs & all House hold Furniture and all
other property that I possess to have & to hold as her ownall the said
property to dispose of Bargin & Sell &C as her own during her natural life &
what Remains after the said Estate after my Just debts are paid of which
there are none of any consequence that I can Recollect & all my small
children Raised at her death my wish & desire is that all my Landed Estate
as above be Equally devided between my two youngest Sons Nameley Jackson
Anderson & George Washington Except the Tract of land and farm where James
Bradley Leased & Lived on when he first moved to this country & my will &
desire is that the above mentioned tract of Land descend to my beloved
daughter Francis Anderson, containing fifty Acres also to include the field
immediately below said tract it is understood that the field last mentioned
is in addition to the fifty acre tract it is further understood that the
fifty acre tract &C Remains in the possession of my wife At her death that
the Lands all as before mentioned are devided as above mentioned my will &
desire is also after the death of my beloved wife for all my personal Estate
to be Equally devided among my Last set of children Except Jackson George W
Anderson & francis Anderson Elizabeth Arrowood Wm D Anderson Jesse W Anderson
& Lazarus Anderson
the above are Excluded from a devide in the personal Estate Lydia Anderson
Nancy Anderson Matilda Anderson Lovisa Anderson & Polly C. Anderson gits the
personal Estate
al so I leave Francis Anderson my beloved wife my Executratrix & Jesse
Anderson my Executor to this my Last will & testament to act clear & free
without giving any security to the County or Court in said county for the
performance or execution of this will and I do by these presents make
disannul and do away all former wills & testaments her to fore made by me
Ratifying this & no other my last will and testament
in witness where of I here Set my hand and seal this sixth day of April 1834
