BUSKIRK-DITTEMORE LAND SUIT COMPROMISED
The litigation that has been pending for years over the possession of the
David Buskirk farm, near Gosport, is at last ended. The case of Thomas Van
Buskirk of Bloomfield, heir of the late David Buskirk, against John W.
Dittemore, of Indianapolis, suit to quiet title to and declare a deed to
this land a mortgage, has been compromised. The case was heard by Judge
Martin at the last term of court. The late David Buskirk, prior to his
death, owed the First Nation bank $5,000. Of John W. Dittemore he had
also borrowed $2,500. He agreed with Dittemore that if he would assume the
indebtedness he would deed him 380 acres of White River bottom land. The
proposition was accepted and Dittemore reimbursed the bank. After
Buskirk's death, Dittemore came into possession of the property and made
extensive improvements. Thomas Van Buskirk, several years ago, brought
suit to declare the deed held by Dittemore a mortgage, and finally
succeeded in doing so. As Buskirk could not redeem the property, he agreed
for the sum of $400 to relinquish all claim and title to the
land. Dittemore will nto have undisputed possession.
