You are correct in your assessment...HOWEVER the bone of contention is the
COPYING of webpages as they are presented on the web....not talking about
the info, but the HTML in many cases is just being copied to the Rootsweb
servers. There is also the problem of someone's time and efforts in putting
the "public" information on a website and then Rootsweb grabbing ahold of
that info without letting the website know about it. Rootsweb is pretty
ruthless when it comes to genealogy when it turns it around and makes money
off of the subscriptions for that information....

There has been an ongoing battle already with Rootsweb and now
appears
this
is another such copycat website....as far as the state can tell there is
NO
legal recourse

This is may be a bit off topic for this list, but I do need to clarify
some misinformation.
While there is a lot of copyrighted material out there, you can't put a
copyright on public information such as dates of birth, death, etc. The
only thing you can put a copyright on is original thought or the
formatting being used for displaying your information, i. e. in a book,
CD, website, etc.
Where some of this stuff comes from concerning Rootsweb and Ancestry
supposedly stealing other people's information stems from something
several years ago when a mailing list group left Rootsweb for another
provider and tried to take the Rootsweb list archive with them which
violated RW's AUP. We're not allowed to store or archive messages posted
to RW lists anywhere else other than Rootsweb. This was done to protect
the individual list user who owns the material in his or her postings. So
a "renegade" list admin can't hijack the archive and move it elsewhere.
What's posted to RW mailing lists stays at Rootsweb.
I could go on but I think this will help clear up some of the confusion.
