I don't know who your "insider" is...but I know for a fact that my pages
were COPIED. The Franklin County pages were also "captured" as you called it
and put in their archives without my permission of taking the webpages. Ho do I know? I
had some incorrect information on a webpage that I later went back and
changed-------------the incorrect info was found VERBATUM on Rootsweb/Ancestry or whatever
you care to call them. Myself and all of the great people that contributed to the
Franklin County website gathering all of the info online to have them suck it away and
MAKE A PROFIT OFF OF IT!

Randy;
I think what you're referring to here is the now infamous search engine Ancestry put
out for a short time.
Even then, they were doing nothing differently that other search engines already do and
that's cache websites. I don't have the link to it right now, but Dick Eastman
did a pretty good job of explaining this several months ago when this supposed controversy
errupted. Contrary to popular belief, Ancestry and Rootsweb is not in the business of
angering its customers. :-) Although there's no denying the love-hate relationship
people have with the company. Much of it, I believe, is based on unfounded rumors.
Again, I don't know where this accusation on copying webpages comes from but
according to a former RW insider, Ancestry and Rootsweb has never done any of what
you've mentioned. However, if there's somebody out there that's housing other
people's information under their own account on the RW servers then it should be
reported to Rootsweb's Help Desk. This would definitely violate the AUP.
Also keep in mind that Rootsweb is the free side of Ancestry so it would be impossible
for RW to turn around and "sell" someone else's information. Again, I think
some of this confusion stems from the family trees stored on both sites. On Ancestry, I
think you need to be a subscriber to view the family trees indexed there, however, if the
same tree is indexed on Rootsweb, you can view it for free. Trees uploaded through
RW's Word Connect is also indexed at Ancestry. This would explain the "copying
of information". Also don't forget, the message boards are duplicated on both
servers. If you post to one board, you're really posting to both sites.
Regardless of how hard somebody finds factual information, you can't own facts.
Ohterwise, we'd all be guilty of plagarism.

You are correct in your assessment...HOWEVER the bone of contention is the
COPYING of webpages as they are presented on the web....not talking about
the info, but the HTML in many cases is just being copied to the Rootsweb
servers. There is also the problem of someone's time and efforts in putting
the "public" information on a website and then Rootsweb grabbing ahold of
that info without letting the website know about it. Rootsweb is pretty
ruthless when it comes to genealogy when it turns it around and makes money
off of the subscriptions for that information....

There has been an ongoing battle already with Rootsweb and now
appears
this
is another such copycat website....as far as the state can tell there is
NO
legal recourse

This is may be a bit off topic for this list, but I do need to clarify
some misinformation.
While there is a lot of copyrighted material out there, you can't put a
copyright on public information such as dates of birth, death, etc. The
only thing you can put a copyright on is original thought or the
formatting being used for displaying your information, i. e. in a book,
CD, website, etc.
Where some of this stuff comes from concerning Rootsweb and Ancestry
supposedly stealing other people's information stems from something
several years ago when a mailing list group left Rootsweb for another
provider and tried to take the Rootsweb list archive with them which
violated RW's AUP. We're not allowed to store or archive messages posted
to RW lists anywhere else other than Rootsweb. This was done to protect
the individual list user who owns the material in his or her postings. So
a "renegade" list admin can't hijack the archive and move it elsewhere.
What's posted to RW mailing lists stays at Rootsweb.
I could go on but I think this will help clear up some of the confusion.
:-)
