This is common because of the way the copyright laws are written. Once
the paper has formatted and put it into some form then it becomes their
copyright. The way around this is by contacting the funeral homes and
asking if they would xerox the paperwork with the obituary information
on it -- that belongs copyrighted to the person who wrote and paid for
it, and sometimes to the funeral home -- ask the funeral home for
permission to use that xerox and family person who paid and gave this
info for permission to put this on the website, digitize that paperwork
and you now have all the information -- and you don't have to get
permission from the newspaper since this is a prior copyright to person
who wrote it, and if revised before sending to newspaper then to
funeral home who revised it (but the newspaper obit is STILL
newspaper's copyright -- so you still can't use that).
Just a way of getting the info without physically copying newspaper
obit or violating the copyright laws.

Our local paper maintains they have exclusive rights to the obits
they
publish, even when the obits are written by a family member and not
"composed" by the paper. My father died a few years ago, so I know
that
the
funeral home essentially writes the obits, but our paper says once
they
publish them, the obits become their property.
Our newspaper obits are online so it would be a simple process to cut
and
paste them onto our INGen website. But the newspaper won't allow
that.
I could just post the link to the newspaper page, but then the names
of the
relatives are not available through our INShelby search engine. So,
I have
been cutting, pasting and then "summarizing" the obits I
want to
publish.
I'm so thankful when the obit is available through the Indianapolis
paper or
the Rushville paper. There is a funeral home in Rushville that is
also
online. Is that routine in other towns/cities?
