There is a Docket Book of the Criminal, Civil & Chancery causes before the
Circuit Court 1828-1842, 261 pp. The Docket Book does not contain an index,
but is simply an avenue to the proceedings in Circuit Court. It does not
provide anything about the proceedings or disposition. A cursory comparison
of the Docket Book and the Circuit Court Proceedings indicate that causes
appearing on the docket sometimes appear at a later term, and sometimes, not
at all. Likewise, proceedings of the court sometimes do not appear at all in
the docket book. Researching in Circuit Court records are very tedious and
only for the truly dedicated or someone with a lot of money for a researcher.
The Circuit Court records, I believe, were among the "rescued" records when
the old courthouse was razed and are housed at Bracken Library. As late as
1991, the Docket Book was still in the office of the Clerk of Delaware Co. A
copy was made by a member of the Delaware County Genealogical Society in 1978
and is probably in the possession of the Delaware County Historical Alliance.
The original may now be at Bracken, or at least a copy??? Anyone interested
in criminal charges should consult "An Enumeration of Criminal Charges Filed
in Delaware County Courts : 1829-1900", by John D. Hewitt, Muncie, Indiana :
Center For Middletown Studies, Ball State University, c1980. This appears to
be most accurate. Maybe there is someone working on their doctorate that
would do an "Enumeration of Divorces Filed in Delaware County" ha.
If you do not live within driving distance of Muncie, e-mail me privately
with a question about a probable divorce cause for a specific couple,
1828-1842, before April 14. I will consult the Docket Book and get back to
you in a couple of weeks, deadline April 14.
GraveNews2(a)aol.com
Just how accurate do you have to be with the date of the divorce? Is early
1900's too vague? My great grandma may have a divorce there about that
time. Is that being too wishy-washy?

I am new to the list. Could someone provide the address for the Delaware
County Courthouse? I would like to obtain a copy of a marriage license.
Thanks.

I was able to obtain a copy of my grandfather's divorce record (1902 and
handwritten) by writing the County Courthouse (Hamilton). They were
extremely helpful and the document was very interesting to read.

HELLO EVERYONE!
I Donata would like to clear up my mistake about the "OLD" "NEW"
COURTHOUSE!
The original Court house was torn down. The current "NEWER" court house
which has been there for years is the one in the same. I'm sorry if I
confused anyone. A few years back they was building the NEW CITY HALL
BUILDING that sits two blocks from the court house. I thought at one
point in time before it was finished someone told me it was gonna be the
new court house that indeed was not the case. (All though both the Court
house and the New City Hall bldg. both have court rooms in them)> I
THINK (I THINK NOW) that in the New City Hall bldg. the court case heard
there are gonna be your more serious crime ect. cases and then all
other's held in the County Court House. I hope this helps fix my mistake
on the court house. At any rate I did phone Bracken Lib. For you all
about Divorce and Michael Twigg says the following about Divorce
records;
1) He would first try the County Clerk's office; they can probably tell
you the Book, page#, and cause #.
2) BRACKEN LIBRARY has the CIVIL ORDER BOOKS (which is mostlikely where
they are recorded into) Michael says that if your coming into Bracken to
see Civil Order Books that you should call first cause they are stored
in a site away from the Lib. and they have to go retrieve them. So call
ahead before going so they have time to get them there before you
arrive.
3) Michael also said that the Muncie Public Library downtown (Carnegie
Lib) has the actual packets (the actual divorce papers) and that you
have to sign to look at them.
Bracken Library: Phone Number is (765) 285-5078
Muncie Public Library - called Carnegie Lib.'s phone number is (765)
747-8208 <this is the genealogy department in the basement.
Clerk of Courts - Marriage records - phone number is (765) 747-7726
Hope this helps some of you.

Would you find divorce records at the County Clerk's office in the "new"
"old" "old" courthouse on Main St in Muncie?
Just a thought.

I would like to hear from anyone who may be researching the KENNEDYS who
purchased land in Delaware Co, in 1835-37; I am especially interested in
Thomas and James KENNEDAY/KENNEDY. I have the will of James who resided in
Rush Co IN, when the will was probated which shows that he and Thomas jointly
owned land in Delaware Co IN. I have the BLM document which also shows the
joint ownership. However, if anyone has a census CD for 1850, I would
appreciate a lookup for Thomas as head of household, along with members of
the family.
