Some of what your friend reports is true; some of it USED to be true. House
Bill 1522 was passed in the 1999 General Assembly and is now codified as
Public Law 100. PL100 make it ILLEGAL in the State of Indiana to:
(1) damage, disturb or destroy any cemetery monument, marker, enclosure,
etc. and
(2) traffick in stolen cemetery art (cemetery monument, markers,
ornamentation, enclosures, etc.).
PL100 also removed the exemption granted for decades to those involved in
"any form of agriculture" to destroy visible signs of a pioneer cemetery on
private property which had never been "deeded out".
There are many issues as yet unresolved by the General Assembly with respect
to the protection and preservation of pioneer cemeteries in Indiana;
however, the passage of PL100 (which went into effect 7/1/1999) was an
important FIRST STEP to address the crisis facing Indiana's pioneer
cemeteries.
