Am forwarding this one as instructed by USGenWeb
Project...most of you probably don't have a clue what
is going on (join the crowd) but basically it
involves someone incorporating the name USGenWeb,
Inc. as a FOR PROFIT business. We of course at the
USGenWeb Project are a volunteer not for profit
group. This person, Jerry Dill, happens to currently
own the server on which
usroots.com pages are housed,
so if you are using this server for anything (I
don't THINK we have any pages there, but just in
case) PLEASE move them.

To ensure that this decision was not taken
precipitately, I asked Jerry
Dill privately once again whether he was prepared
to make any
further
commitment with the
usgenweb.com domain than he has
previously
done
(i.e., to allow the NC to be listed with InterNIC
as the
administrative
contact for the domain).
His response was that that offer is exactly equal
to the status of .net
and .org and that he's made all the offers he's
going
to make, the next
move belongs to the board.
>From that I can only gather that he really does
not understand the
difference that many of the rest of us see in that
public
commitment
that Brian and I made that the domains belong to
the project,
and that
he will not make.
In any event, we must go on: while we don't have a
lawyer, and have
received no official legal advice, we've receieved
a number
of
unofficial legal opinions, and they all point the
same
direction: that
there's a risk that allowing USGenWeb material to
remain on
the Dills'
server or at
usgenweb.com at this time could be
interpreted in
the long
run as consenting to USGenWeb, Inc ownership of
those pages.
Until we get a clarifying and official opinion,
therefore, I believe
that we will have to cease all use of
usgenweb.com and move
any pages
that are still on the Dills server elsewhere.
If your pages fit into that category, please move
them as soon as
possible. You're welcome to take them wherever else
you'd like;
http://www.rootsweb.com/cgi-bin/local/mailmerge.cgi/~mogenweb/templates/c...
is the form to request space if you want to go to
RootsWeb.
I'm really sorry it's come to this, but I truly see
no alternative for
the protection of the project.
