I'm not sure which "both" books you are referring to as one of the books
mentioned was written by Mr Steele and the other by E.G.Elliott.
However if both books are available in the LDS files then that it great news as it means
that people can access those books themselves via the LDS without having to purchase a
copy from somewhere or finding them in a local library or genealogical centre.
That however does not permit copying of information and disseminating that information by
any means without prior permission and does not mean that these books are out of
copyright. The LDS rules for accessing anything in their files is very clear and nothing
at all from their files can be copied and disseminated without prior written permission
from them. The LDS are very clear on that fact that access to their records is for
personal and private use only as that is the licensing terms that they have agreed with
the various parties that they have sourced information from. No other use is permitted.
Distributing without permission is prohibited in all cases.
For those reasons there is no longer anything on fermanagh-gold that has been sourced from
the LDS with the exception of where permission has been obtained from the relevant
parties. I would therefore urge anyone who has previously copied information from the LDS
and provided it to fermanagh-gold to approach the LDS to get explicit permission so that
the information can again, if permission is granted, be made available to everyone. We
have already been successful in getting such permission for some records.
Likewise I would urge anyone who has copied and distributed church records to also
approach the PRONI and or church involved (depending upon where the records were sourced
from) to obtain permission so that those records can again be made available on
fermanagh-gold for everyone to use. The publishing of church records is in all cases
unlawful without prior written permission from the church involved; no matter how
inconvenient that may be. Failure to do so is unlawful and a breach of property rights
(not a breach of copyright). The church or state owns the registers in every case and that
ownership conveys certain property rights. Those property rights are violated when
information is copied or distributed without permission. The systematic breach of these
rights is a criminal offence in all countries relevant to this forum. We have already had
some success with gaining permission to lawfully publish some church records and more
should be made available for everyone soon.
