Your math amazes me. Here we have a couple who were married in 1768 who
supposedly had a son, Beverly, who was born ABT 1760, age 74 in 1834. They
just did not do such things such as that back then, especially since
Penelope, at the earliest DOB listed for her, 1749, would have only been 11
in 1760. Good try, though.
Concerning the 1784 will and children of Robert DANIEL, you seem to have
listed the research of Norm McHAN but he did not list his source in the
documentation I have seen. From all of the stuff out of Middlesex, it would
seem someone would have produced this will in its entirety.
I think we need to straighten out this family, as we did Chesley and
JWC. There are just too many Beverly and Chesley DANIELS floating around
this bunch for my tastes and all too many of them possibly assigned to the
wrong individuals.
As for what we know, I think that Beverly, the US Marshall who died in
1840 in York County, SC, was a son of Chesley and JWC and the Chesley
DANIEL, Esq. who married Betsy WEIGHTMAN in 1811 in Raleigh, NC was a son of
Josiah DANIEL and Elizabeth KEY but that is just my opinion. That, will
agree with what I have read, somewhere, that Beverly was young Chesley's
uncle but they also could be brothers, I just do not know but what I do know
is that young Chesley was not mentioned in his father's will and a Chesley
matching the age profile of this Chesley was living right next to Josiah
DANIEL in 1810 in Granville, as I remember.
Yes, Penelope LEE was a LEE. She was the daughter of Charles LEE, Jr.
(1717-1792) and Penelope CHENEY (1721-BEF 1719), one of the youngest of nine
known children of this union. Charles was the son of Charles LEE, Sr.
(1683-1719) and Dorothy HENRY (ABt 1683-ABT 1757).
Penelope also married Rev. Robert WARE (1740-BEF 27 Feb 1804) on 20 Oct
1794 in Middlesex County, VA. There is some conjecture about his parents
but most list them as an Edmund WARE and a Susannah of Middlesex County, VA.
Rev. WARE supposedly died in King and Queen County, VA but there is some
mention of Essex County, VA around this bunch, so I do not know where he or
she died but most say, Middlesex County, VA for her. Usually in these
"September" marriages the wife is usually buried with her former husband and
the husband with his so she may have died, elsewhere, and buried with Robert
in Urbana, Middlesex County, VA where they actually lives, according to my
notes. The name of Rev. WARE's first wife is not known.

A couple of points - first, she is Penelope Lee, not Penelope Lee Daniel -
from the Christ Church Parish Records, Middlesex Co, VA married 29 Dec
1768.
Second, yes, there is a will for Robert Daniel: dated January 1, 1780
and
proved September 27, 1784. I do not have a copy of the will, but it names
wife Penney, sons Henry Daniel, Robert Daniel, Beverly Daniel, Garrett
Daniel, George Daniel, and daughters Jean and Betty Daniel.
Now, if we tie that information to the info that I found in Marriage
License
Bonds of Lancaster County, Virginia, Nottingham, Stratton, 1927, page
19 :
Daniel, Beverly m. Judith Brent Bailey 13 Mar 1803 William Carpenter sec.
Daniel, Garrett m. Sally Riveer 8 Feb 1806, Martin George sec.
Daniel, Robert m. Hannah Rogers 22 Aug 1797, John Rogers sec.
You can see that Beverly Daniel, son of Robert Daniel and Penelope Lee is
the Beverly Daniel who married Judith Brent Bailey.
Also, I have not researched them thoroughly, but there are records for
both
a Garret Daniel and a Beverly Daniel in Kentucky in he early 1800s.
One
of
the records for Beverly Daniel is an 1835 Revolutionary War Pension
census -
Revolutionary Soldiers in Kentucky, Roll of Citizens of Kentucky,
Page
128,
Beverly Daniel, private in Virginia Militia, $30, March 10, 1834, age
74.
Being 74 in 1834 makes this Beverly Daniel born ca 1759-60. He was still
on
the pension rolls in 1840 - listed in Montgomery County, KY, age 78.
This is not proof, but it is rather suggestive that the Beverly Daniel,
son
of Robert and Penelope, may be the one who moved to KY.

Marshall, of Raleigh, NC, was in fact the Beverly Daniel who was the son
of
Robert Daniel and Penelope Lee Daniel?
I don't think that it shakes down that way. If these two pieces of data
are
accurate, the Beverly Daniel who was the US Marshall, and Adjutant
General
of NC was the son of Chesley Daniel and Judith W. Christian:
The National Genealogical Society Quarterly, Volume 34, Vital Records from
the Tarboro Press (N.C.), 19 September 1840, Page 4: "Daniel, General
Beverly, Adjutant General of NC Militia, U. S. Marshall, died lately in
Raleigh."
Now, add that to this tidbit:
From the will of Beverly Daniel, "admitted to probate at Novembers
session,
AD, 1840 and entered on record. In
testimony whereof I have hereunto affixed the seal of said court, and
subscribed my name at Office in Raleigh the 17th of May 1841".
"I Beverly Daniel of the city of Raleigh in the State of North Carolina,
do
make this my last will and testament; I give and bequeath all my
estate of
every description, real, personal and mixed, to my two brothers James
Daniel
and John Daniel.............for my brother Woodson and his present
wife
Elizabeth"
Clearly, these are the same people named as sons of Chesley Daniel in his
1814 will. It being totally unbelievable that two different Beverly
Daniels
would die in Raleigh in the fall of 1840, this seems to make it clear
that
Beverly son of Chesley and Judith Christian Daniel was the AG and US
Marshall.
