Over the last month Rootsweb has been updating their list server software.
The COLBY list has been successfully migrated to the new Rootsweb
software. There is very little in this change that should affect most users.
But there are a few things to note:
1) the list name will no longer have the "-L" at the end. This may
affect your filters if you have your email program set to deliver this
list into a certain folder. The new list address is COLBY(a)rootsweb.com
2) it will no longer be possible to subscribe to both the regular list
and the digest version from the same email address. If you feel you
need both, you'll need a second email - perhaps yahoo, hotmail, or
gmail.
3) Digest now comes as one continuous message, which is the default.
In the past the Digest contained individual messages as attachments.
For those who still want to receive their Digests with each individual
message as an attachment, email me and request that I change your Digest
mode to MIME. AOL can't read MIME.

After hearing a number of motions this morning, the slander case from Macon
was called up for trial.
Wants $20,000
It is the case of Mrs. Clara McGee vs. Lewis S. Colby, a farmer living near
Macon, the owner of 600 acres of land. The plaintiff places damages at
$20,000, alleging that the defendant has slandered her character by
declaring that she has been guilty of adultery. Her attorneys are Senator
W.C. Johns and I.A. Buckingham and Cyrus Randolph. The counsel for the
defense are the Mills Bros. The case is on trial by Jury.

Third Trial of the Slander Action
Entries on the Docket
Judge Vail resumed court this afternoon and after making a number of entries
called up the slander case of Mrs. Clara E. McGee of Macon, vs. L.S. Colby,
an action in trespass, claiming damages for slander on the part of Mr.
Colby. There have been two long drawn out trials on the case. The first
time the jury disagreed. At the second trial, the jury gave the plaintiff
$1,250, but the defendant's motion for a new trial was allowed, and now the
case comes up for a new trial. All parties were ready to proceed and the
work of selecting a jury began at 10:15 a.m. The attorneys for Mrs. McGee
are Buckingham and Shroll and Johns and Randolph. The defendant is
represented by Mills Bros. and Mills and Hon. Horace S. Clark of Mattoon.
Every point in the case will be closely contested.

The McGee-Colby Slander Case
The McGee-Colby slander case, wherein Mrs. Carrie E. McGee, wife of Albert
McGee, residing at Macon, sued C.S. Colby, formerly of Macon, now living in
Decatur, for slander, claiming $5,000 damages, has at last reach a final
conclusion. The result of the first trial was a disagreement of the jury.
The second trial resulted in a verdict for the plaintiff, the jury assessing
damages at $1250. On the ground of some defect in the evidence, a new trial
was granted. In the last trial Buckingham and Shroll and Johns and Randolph
appeared for the plaintiff, and Mills Bros. and Clark for the defendant.
The case was well tried as all the attorneys are prominent in their
profession After the evidence was all in the Judge limited the attorneys in
their arguments to one and a half hours for each side. The case went to the
jury yesterday evening. Judge Vail instructed the jury to bring in a sealed
verdict, and having done so, they would be at liberty to go home until the
court again convened, which it would not do until Monday afternoon. The
jury repaired to their room and wrestled with the case until 4 o'clock this
morning, when they reached a verdict, which they sealed and handed in as
directed by the court. It is, of course, not know positively, what the
verdict is, but from some pointers a representative of the REPUBLICAN got,
it is safe to say that the verdict is for the plaintiff, fixing the damages
at about $500.
Thus, it is supposed by those who ought to know, will be the end of this
case.

Marilyn Colby Moody, 79, died at home on 2 Grandview Road in Bow, NH., in the early morning hours of Saturday, Sept. 16, 2006. She was born Jan. 3, 1927, a daughter of the late Frank and Hazel (Myers) Colby, of Bow, NH.
She is survived by her husband of 59 years, Harvey C. Moody of Bow, sisters Phyllis C. Gordon of Bow and Betsy C. Tillotson of Concord; and cousins, nieces, and nephews. She was predeceased by four sisters and four brothers.
Graveside services will held at the Alexander Cemetery at the convenience of the family.
Good work, Alice! So...she's not ours at all, huh? Apparently, like many Hollywood personalities, she ditched her birth surname for something more glamorous (and less "old country" sounding)? At least she had the good taste to choose a really distinguished surname for her pseudonym!

I would also be interested in knowing more about this woman. My branch of the Colby family has a 120 year tradition of using the traditional male spelling (Marion) as a female name -- I have at least four women with that name in my data base, including my own daughter. I do have a couple of collateral Colby lines that wound up out in California, but so far as I know, the subject entertainer is not connected to them.
If anyone comes up with a traceable Colby lineage for this Marion Colby, I hope you will post it to the list.

Reginald C. Colby
Reginald Carroll Colby, 84, of Bearden, Arkansas, died of pneumonia after a long illness on Monday, February 2 at Story County Medical Center, Nevada, Iowa.
Born on April 3, 1919 in Wiscasset, he was a son of Lennie and Ethel "Nanny" (Davis) Colby.
On October 25, 1974 he married Lurlie Summers in Memphis, Tennessee.
During World War II he served in the United States Army. He retired in 1974 as a superintendent of large construction.
Mr. Colby attended the Assembly of God Church in Bearden, Arkansas until his illness rendered him homebound. He was an avid hunter, fisherman and a Master Woodworker.
Survivors include his wife, Lurlie of Bearden, Ark.; two step-daughters, Gale (Ernie) Herrera of Altoona, Ark., and Reyna (Wade) Evans of Michellville, Ark; two sons, Brandon Colby or Orland, Calif. and Randall Colby of Calif.; two daughters, Rebecca Callan of Concord, Calif. and Stephanie (Ron) Campbell of Orland, Calif.; one brother, Le Roy (Lillian) Colby of Wiscasset; one sister, Dorothy Palus of Bath; six grandsons; one granddaughter; one step-grand-son; and one step-great-grandson.
He was predeceased by his parents; one sister, Louise Pinkham; and one brother, Perley Colby.
Memorial services were held February 6 at the Story County Medical Center Chapel with Pastor David Burling officiating. There was also a memorial service held February 10 at First Assembly of God Church in Bearden, Ark., with Rev. Charles Taylor and Rev. Wayne McGuire officiating. Burial of the cremains will be at Moss Hill Cemetery in Bearden, Ark.
In lieu of flowers, a memorial fund has been established for the Story County Medical Center Foundation, 630 6th Street, Nevada, Iowa 50201.
Arrangements were entrusted by Chet Ryan Mortuary.

Allie Mirth Casto Colby, 91, passed away August 6, 2004 in Richfield, Utah. ?She was born Sept. 16, 1912 in Salina, Utah to Rudolph N. and Ruby Lillian Jensen Casto. She grew up on a Gooseberry ranch, attended school in Salina until she was 14, then attended Jefferson High School in Los Angeles, CA.
Allie married Clinton Colby on Sept. 24, 1930, they later divorced. She has been an active member of the LDS Church, where she served in many callings in the Primary, Relief Society and stake Relief Society. She was called to serve a full time mission in the California-Fresno Mission. She worked at the Grand Western Caf?, Pahvant School, Rowleys Sheet Metal, and Bradshaw Auto Parts.
She is survived by children: Clinton Lee (Dorene) Colby of Roy, Cloyd Colby of Mission Viejo, CA; Sjon (Julie) Colby of North Salt Lake; Chett (Carolyn) Colby of Bellville, TX; Micala (Deno) Jensen-Blau of Providence; Rusty Colby of Richfield; 21 grandchildren; 17 great-grand children; sister, Mary Hansen of Richfield; brother, Glen (Yvette) Casto of Bellingham, WA; sister-in-law, LeAnn Casto of Holladay.
She is preceded in death by her parents; son, Zane; brothers and sisters, Tony, Ned, Ruby Dell, Eva Mae, Lucille and Jack; son-in-law, Rex Jensen. Graveside services and interment will take place on Friday, August 13, 2004 at 11:00 a.m. in the Richfield City Cemetery.

FORMER LAKE COUNTY PIONEER PASSES AWAY
Mrs. Fanny Colby died at Cory, Pa., at the home of her son, Mason Colby, on Thursday, August 26, at the age of 82 years.
Mrs. Colby was a resident of Barrington and Diamond Lake for many years, and was well known by the older residents of these villages. The past few years she has spent with her son.
She was laid to rest in Diamond Lake cemetery on Saturday, August 28. Rev. Johnson of Area officiated at the last services.

Mrs. Amelia Colby Died at Her Home on Grove Avenue After an Illness of About Six Weeks
CANCER OF LIVER CAUSE OF DEATH
Was 75 years Old and Retained All Faculties Until Day Before Death --Funeral Tomorrow Afternoon.
The death of Mrs Amelia Hawley Colby of Grove avenue which occurred at 11 o'clock Wednesday morning, August 18, had been expected for days. She became ill about six weeks ago and had been apparently well before that time; the affliction proved to be cancer of the liver although its existence had not been realized. For 48 hours before death she was unconscious but previous to that time had retained all faculties and was a very active woman in mind and body for one of 75 years.
As an early resident of this section she was known to many of an older generation, being a member of one of the Yankee families that first developed this community. She was a very pleasant woman to know and a good friend to many who with her two elderly sister who live in Barrington will miss her and mourn her departure from this earth.
Mrs. Colby's birthplace was Orleans, Ontario county, New York, and the date was June 7, 1840. Her parents were William and Harriet Hawley who moved west when this daughter was six years old. They lived on a farm southwest from town, across from the old Henry Hawley place on the Elgin road. When a young lady Miss Amelia Hawley taught several district schools in Cook and Lake counties in the vicinity of Barrington and was later married to Enoch Colby of Chicago. He was soldier in the Civil war at the time and came home on a furlough to be married, after which he served another year in the war. They lived in Chicago for 35 years near 31st street and Cottage Grove avenue. Mr Colby was a government grain inspector and came of a prominent family of the city at that time.
Thirteen years ago they moved to Barrington and lived on Hough street with Mrs. Addie Johnson, a sister of Mrs. Colby. Eleven years ago last December Mr. Colby dropped dead in the Barrington cemetery while up there to show the sexton where to dig a grave for the burial of a niece who was to be brought here. A year and a half ago Mrs. Johnson and Mrs. Colby and their grand-niece, Miss Ruth Horner who lives with them, moved to Grove avenue, north of the Baptist Church.
The only organization to which Mrs. Colby belonged of recent years was the Woman's Christian Temperance union although she once belonged to the Woman's Relief Corps. She never joined a church.
Surviving members of her father's family are the two sisters, Mrs. Addie Johnson and Mrs. Emily Brown of west Main street; the brothers are Charles Hawley of Hebron, Illinois, and Frank Hawley of Hanna, Indiana; the late Fred Hawley, mayor of Barrington, was a brother, also of this lady.
The funeral will be held at the home on Friday afternoon at 1 o'clock and Dr. W. J. Libberton of the Methodist church will take chare of the service.
