Before I ask my question I want to take a second and wish everyone a
wonderful and safe holiday.
I just purchased this really neat book, CAPITOL'S WHO'S WHO FOR DENVER AND
COLORADO, 1940-41-42. It was "compiled and published" by Capitol Publishing
Co. (Denver), R. O. Norman, Editor. Capitol Publishing Company has
apparently gone out of business, been bought out by another company that
changed it's name, or something. My question is this--how to I find out
where to write to ask permission to use the book for lookups and/or to put
it online?

(The following copyright comment is probably too basic but some of our cc
are new.)
I can't help track down who holds Capitol Publishing's copyrights but:
1) Since a "Who's Who" is a compilation of facts about people you would
have no problems extracting individual entries to answer lookups even if
the copyright is current. You would also have no problem extracting and
publishing an index to the names in the work.
2) The original copyright would have expired in 1971 (1943 + 28 years). I
would think that it is very unlikely that the copyright to a work of this
type would have been renewed before it expired. Therefore it would have
received no protection under the 1978 revision or the 1998 revision of the
copyright law. You _should_ be safe making a transcription of the complete
work. However, as you know, the USGenWeb's "play it safe" policy is to
always ask permission if the original copyright is after 1923 (1998 law
revision - 75 years).
The bottom line (from my understanding of the law) -
o You are safe publishing an index of the names mentioned and providing
lookups.
o USGenWeb policy requires permission for a transcription of the entire
work.
