The only Agnes Clements I have in my data base is the daughter of Captain Benjamin
Clements, but this Benjamin did not die in Texas.

I recently was trying to find info on where Benjamin Clement died in
Texas. I was on the Texas Gen Web queries and came across a man who is
doing research on the 10th Texas Infantry C.S.A.. He is looking for
descendants of Benjamin R. Echols who was part of a group of enlisties
in Fairfield, Freestone Co. Texas.
Benjamin Echols is the son of Champness and Agnes Clement Echols. His

Marna mentioned that no descendants of JURIAH CLEMENT born 1741,
daughter of Benjamin and Susannah, had as yet responded to the rootsweb
list. I was hoping that one would appear! I have interest in her line
as JURIAH married a GILBERT and had two children, JAMES and RACHEL,
before she pre-deceased her father, who died in 1780. JOHN WEBSTER
GILBERT (Patsey's father) born 1738, son of Samuel Gilbert and Martha
Webster, also had two children named JAMES and RACHEL GILBERT. For
certain John W. Gilbert's wife between 1776 and 1794 was Rebecca
according to land records.
Can anyone help me sort out if these are two different Jameses and
Rachels or in fact the same people? I have some excerpts from documents
trying to show some of the interaction between the Clements, Gilberts,
Butterworths, and Lynches. James Clement named a son, Webster, so it
may be that family name could fit into the picture somewhere also.
This is an excerpt from the 24 Nov 1807 Lincoln Co. KY will of JOHN
WEBSTER GILBERT which does list all of his children later as JAMES,
RACHEL, John, Isham, Sally, and Patsey: "Now, I leave unto James
Gilbert and Rachel, my daughter, an equal part of all stock with the
rest of my children, after the two-thirds taken out; and the land to all
my children in Shelby [Shelby Co. KY] as it was laid off for them."
"James Clement is to have the land he bargained for with Daniel McKinney
and fifty acres more I promised him that was never laid of, for which he
is to pay one hundred dollars."
According to his will, James and Rachel seem to be set apart from the
rest of his children which makes me wonder if they were from an earlier
marriage: James and Rachel are probably his oldest children as James
married in 1782 in Bedford Co. VA to Martha Gash, and Rachel married in
1788 in Campbell Co. VA to Daniel McKinney. Sally was the first of the
rest of the children to marry seven years later in 1795 in Pittsylvania
Co. to Seburt Crutcher, John married in 1797, Isham married in 1799, and
Patsey in 1800.
According to the "History of the Gilbert Family of Maryland, Virginia,
Kentucky, et al." compiled by Mary F. Price FHL #0259315 on page 39:
"JOHN WEBSTER GILBERT had also purchased a large tract of land in Shelby
County (later Spencer County) on Brashear's Creek, where he settled
'some of his children'. JAMES and RACHEL, who were both married before
they left Virginia, were among those who went to live in Shelby County,
and later we find Sebert Crutcher and his wife, Sally Gilbert Crutcher,
in this same community." [They were listed on a 1810 Census in Shelby
Co. KY].
The following shows the acquaintance between Gilbert and CHARLES LYNCH,
possibly son of the Charles Lynch that was gunpowder maker partner of
BENJAMIN CLEMENT. Continuing on page 40: "Affadavit copied from old
paper in possession of Mrs. James G. Scobbe, of Bardstown, Ky.:
'I, James Mahoney, of Shelby County, do hereby Certify that some time in
the year 1794 in Virginia being Overseer for John W. Gilbert, had an
opportunity of being some little acquainted with a Contract that took
place between said Gilbert & Charles Lynch & George May concerning the
land. From information from said Gilbert & Charles Lynch and George May
in Contract for land in the State of Kentucky entered by George May,
John May, & Floyd, said George May sold to Chas. Lynch and Jno. W.
Gilbert his part of the undivided right of land in Kentucky for which sd
Gilbert gave up the plantation whereon he livd in Campbell Coty
Virginia. at one thousand pounds to Geo. May for which sd Lynch & May
signd over Fifteen Thousand Acres of said land to said Gilbert in the
latter part of 1794 or beginning of 1795. Said May took possession of
said plantation & settled his mother there. As well as I recollect said
Lynch paid said May two or three valuable plantations, and after we came
to Kentucky in 1795 in Mercer County said Gilbert & sd Lynch myself
present I heard said Lynch inform Gilbert to settle on any part of said
land & it should be his in the division & said Gilbert made choice of
land near the mouth of Brashear's Creek entered in the name of Jno. May
& settled his Children there."
Another record showed an indenture made and entered unto this 23 day of
Nov 1794: "Between John Webster Gilbert and Rebecca his wife of the
county of Campbell of the one part and Charles Lynch of the said County
of the other part. Witnesseth that the said John Webster Gilbert and
Rebecca his wife for and in consideration of the sum of fifty pounds
current money of Virginia to them in hand paid the receipt where of they
do hereby acknowledge Have granted, bargained, sold, aliened, ?
confirmed, and by therefore sent doth grant, bargain, sell, alien, ? and
confirm unto the said Charles Lynch his heirs and assign forever our
certain tract on parcel of Land containing three acres be the same more
or less, situates lying and being in the county of Pittsylvania on
Sycamore creek and bounded ... " Document photocopied by Diane Homola in

Does anyone know just who this WILLIAM CLEMENTS is that is mentioned in
the Bedford Co. VA 9 Aug 1776 Will Book A, p. 247 of SAMUEL GILBERT,
SR., father of JOHN WEBSTER GILBERT? An excerpt from that will: "I
give and Bequeath Wm. Clements 250 Acres of land lying on the west side
of Seneca Creek Joining the Webster Gilbert and to Molly Welch whereon
he now lives after he has paid the remainder of the money which is
Seventeen pounds Seven Shillings and Six pence. I give or leave 200
acres of land to Webster Gilbert lying on Jonas' branch the land which
he bought of James Clements, ..." This James would seem to be the son
of Benjamin and Susannah and father of James Jr. that married Samuel
Gilbert's granddaughter, Patsey, but that has not been proven as I have
not found any records showing that James owned land on the Jonas' branch
[of the Seneca].
In researching my husband's Gilberts, I learned that the Clements,
Butterworths, and Gilberts all lived near one another. This was copied
from page 44 of "The Butterworth Family of Maryland and Virginia"
compiled and written by Walter V. Ball: "Benjamin's [Butterworth
married Elizabeth Clement] first child, Isaac, was born in Virginia in
1768 and in 1794 Isaac [in 1792 Isaac married Elizabeth Walker in
Campbell Co. VA] purchased from John Webster Gilbert 200 acres
'beginning at a deep ford on Seneca Creek, adjoining the land of
Benjamin Butterworth who took up 260 acres in 1786 'on the Staunton
River, including six isles, island sluices, rocks and falls'. We can
thus locate the Butterworth lands on the south side of Seneca Creek
where it merges with the Staunton River." "It is possible that Benjamin
came to Virginia when his brother, Isaac, died in 1766 in order to be of
assistance to the widow and small children. We do know that he met and
married a young girl by the name of Elizabeth Clement, daughter of
Benjamin Clement, who lived just across the Staunton River in
Pittsylvania County. Benjamin and Elizabeth had four children: Isaac,
Stephen, Jamie and Susannah, mentioned in Mr. Clement's will. Elizabeth
died quite young as Benjamin remarried in Baltimore City, Md. in 1779 to
Sarah Hoskins and they had eight children."
With all that confusion I thought that I better repeat the questions!
Can anyone help me sort out if these are two different James and Rachel
Gilberts or in fact the same people? Does any out there recognize which
William Clements was in Samuel Gilbert's will?

A number of you have written to see if I'm still breathing, as I have been
unusually quiet lately. Aside from having computer problems -- my tech has
had my computer more than I have -- and starting a new job that has taken
way more time than I thought, I am trying to shovel out my computer room

My interpretation is that William Clement Sr (d 1760) was the father of
John Clement who married 1745 Frances Booker, and who died 1791; and
that John Clement Jr who died 1783 was son of John Clement who died
1791.
Note to David Clement: My extraction of the above will of John Clement
does not identify a wife Sarah , nor a son Edward, nor a daughter Nancy,
as you indicated in your message of Sat. 14 Nov 1998. It names only one
daughter Jean Tabb. I did not identify the other people named in the
will.

NOTE: Mrs. Maud Carter Clement, wife of Nathaniel E. Clement, in her
book "The History of Pittsylvania County, Virginia", 1981, wrote:
p 42, "Benjamin Clement of Amelia, patented land on Sycamore Creek of
Staunton River (Pittsylvaniua Co.), where a few years later he made
his home."
p 145, footnote: "Benjamin Clement married Susanna Hill, daughter of
Col. Isaac Hill of King and Queen County and moved with his family to
Pittsylvania (then Lunenburg) in 1748, establishing his home at Clement
Hill, a sharp knoll overlooking Staunton River."
It would be most helpful if someone would submit extracts of the
Pittsylvania County land transactions for Benjamin Clement.

Jeannette Holland Stucki and Dorothy Holland Herring.
Has anyone looked at this 'collection?' What does it include?

Thank you for your replies about Ann CLEMENT's renunciation.
I recall that DeRoy did mention the renunciation earlier to the group when
he shared the will of William CLEMENT Jr. (d. 1766). The timing in this
intrigues me. The will of William CLEMENT Jr., although dated Jun 1764,
was proven Jun 1766. His wife renounced her rights 25 Jul 1766 (Amelia Co,
VA, Deed Book 9, page 57). But, she didn't marry next until Jan 1768. I
thought that perhaps she stood to benefit differently by claiming her
rights under the dower laws than through the will. I haven't taken time to
look at the estate distribution records to see what she actually did
receive from the estate to compare. Not that it is really that important,
I was just curious.

I don't pretend to know Virginia law, but the first thing that occurs to
me is that she might have had more to gain through the laws of intestacy
than she she did through the will. Just a thought.......
