On 26 Feb. 1806, Joshua CLARKSTON/CLAXTON bought 247 acres from Peter FISHER
that was located along Rocky Creek in the first district of Sumner County, TN.
It appears that this was in the part of Sumner County that became Wilson County.
According to the U.S. Geological Survey, Rocky Creek is a variant name of the
stream called Rocky Branch. It is located in the eastern part of Wilson County,
very close to the borders of Smith, DeKalb, Cannon, and Rutherford Counties -
south of Watertown, north of Auburntown, and west of Liberty.

We might be able to find a descendant of Joshua Claxton. A local descendant
has done a lot of work on that family. I don't think I ever heard of this
Jeremiah before, but there is a younger Jeremiah in Marshall County (the
portion taken from Bedford in 1836). You are aware that a descendant of the
younger Jeremiah has already taken a DNA test.
I not only need to go to the courthouse--I need to go through my books. I
have that book by Charles Sherrill that you quoted and I don't know why I did
not locate the Claxtons in it!!

I am completely thrilled by all this information!! I spoke to (Mary) Sue
Smith today about the Mero District records and she said in some cases there
was nothing but an index, but in some cases there are loose papers. Sumner
County has a wonderful archives. I will see what I can find out.
We already had some information about a Joshua Claxton and a James Claxton
(whose marriage was bonded by Anson Claxton). Thomas is a new entity. It
sure does sound to me like this may be brothers who inherited the land from
their father!!

Joshua, James, John, and Thomas CLAXTON are all mentioned in connection with the
following three different court suits filed by Alexander McMillan:
David Woodward received a military bounty land warrant for 247 acres on
15 Feb. 1797, warrant #4718, which was assigned to Peter Fisher on 1
April 1797. Peter Fisher located #7235 on 15 April 1797, had it surveyed
in 1801, and assigned it to Joshua CLARKSTON on 26 Feb. 1806. This
warrant was mentioned in the Glasgow land fraud because the soldier was mustered
for only 18 months and the warrant assignment had been forged. (source Tennessee

A conflicting claim arose because William Brown received a land grant of
640 acres, which he assigned to John Ford, which he then assigned to
Martin Armstrong in 1795. Armstrong had this surveyed in 1799, and he
sold it to Alexander McMillan in 1806.
Joshua CLAXTON and Alexander McMillan both claimed the same 247 acres tract on
Rocky Creek in the first district of Sumner County, TN. At some point Fisher and
Armstrong had entered into arbitration over their holdings. The suit was filed
in Sumner County Court in 1808, appealed to Mero district Superior Court, and
from there transferred to Sumner County Circuit Court. When McMillan died, his
heirs revived the suit in 1817. The jury decided in favor of Claxton and the
Supreme Court affirmed the Circuit Court ruling. (source Tennesseans in Court,

On 22 Sept. 1808 the suit of Alexander McMillin against James CLAXTON for
trespass assault and battery was heard in court in Sumner County. McMillin won
the case and damages of $25 were assessed against CLAXTON.
On March 17, 1809 Alexander McMillan, through his attorney, ammended his caveat
against Joshua CLAXTON inserting that he also claims the land surveyed for
Joshua CLAXTON by virtue of two entries made on military warrant #5120 for 640
acres: #12 for 200 acres entered 1 August 1807, and #2706 for 440 acres dated 7
Nov. 1808.
On March 21, 1809 the case of Alexr. McMillin against Joshua CLAXTON was
continued in Sumner County Court where evidence was submitted showing that
warrant 938 was assigned to Martin Armstrong and the defendant's survey does not
correspond with his entry. The court ruled that no grant should be issued to
Claxton for land caveated by Alexander McMillan. Claxton obtained an appeal to
the Superior Court. John Shaver and James CLAXTON served as securities.
On Sept. 18, 1809 the case of the State vs James CLAXTON, peace bond, for the
defendant to keep peace particularly towards Alexander McMillan was submitted to
court, James Blakemore and John Shaver, securities.

Wilson and Smith Counties were formed from Sumner County, TN. We know that John
CLAXTON moved from here to Bedford County, TN. Were Joshua, James, and Thomas
CLAXTON related to him? Is anyone tracing these other three families? Could we
get a DNA test from these other three families to compare to a descendant of
John CLAXTON to prove whether they were related or not?

I'm looking for the Claxtons from Grainger County, Tennessee in the late 1700s - early 1800s. My Mary Claxton married Joshia Kidwell in Greene (now Grainger County) County in 1795. In 1800 Joshia witnessed a marriage in Grainger County between an Anne Claxton & a David Evans.
I'm wondering if this Anne was a sister to my Mary, and, if so, who their parents were?
