Hi Mary Jean and List,
Thanks for posting what you did Childrey Creek it is
Halifax and is still known as such today by your first
posting. I read what The Childress list posted on the
creek it was very vague .There is both towns of
Childress and Childry(early records state it was named
Childrey) in Virginia but they are not very close
together. I'm going to try and contact Halifax
Historical Society and see if they know how the town
of Childrey got its name. Benjamin Childrey took out
large patents there he would be my guess.I post if I
find out.Cindy

Hi Mary Jean and List,
I am the minority in the
Childress/Childers/Childree/Childres today there are
many more of you then Childrey. All of my line descend
from Thomas and Nancy Childrey (never written as
anything else)of Henrico County who died in 1788 and I
believe Thomas was born around 1745. He had a
plantation and a fair amount of land I don't know who
were his parents.I believe but have not proved his
uncle Thomas Childrey (Childrey in the Will)gave him
two hundred acres of that land one hundred of it was
bought from John Hobson, in Thomas' will the land is
given to Thomas son of Benjamin. From a book record I
found In Henrico court 1765 Will of Benjamin Childrey
presented by Thomas Childrey executor wit John Redford
(My Childrey's neighbors) and Daniel Stone(connected
to William Stone son in law to Thomas Childrey died
1758?)that is all it said I understand this will was
destroyed by the british but I believe it would have
told me everything.(I also think my Thomas(died 1788)
owned the land Thomas Childrey bought from Joseph
Pleasents for L26 in 1707 which Thomas this is I don't
know but with two Hatchers wit I would think it was
the Thomas who died in 1758. Did this Thomas Childrey
come to this country in 1704 as some state and these
branches of Childreys came from him?(Does This Thomas
connect with Jeremiah and John in Amelia why didn't
they stay in Henrico?) There is a branch of Childrey
in Halifax who I believe have been there before 1780's
when the town of Childrey and Childrey Creek were
named. I have been in contact with them and they say
there are two Childrey lines in that area but can not
tract their line back past 1800. I have not been in
contact with the Charlotte Childreys to find out if
they know anything.Any comments would be greatly
welcome I have looked at records and do not have any
more proof then when I started more than ten years ago
I'm just guessing like the Ve gen papers. Cindy

Hi List,
For those interested in the placename connected to the Village of CHILDREY in
Oxfordshire, England - See the following web address -
http://www.finalword.com/ubd_www/Childers.htm
The above address will give you a little information regarding "CHILDERS"
Australia and the name orgin which they say is taken from the village of
CHILDREY in Oxfordshire, England.
MaryJean Childress Voegtlin
Hi List,
REF - Comments regarding "VA Gene Magazine" articles titled "Abraham Childers
lll" and the place name of CHILDERS - Australia - (see previous post from
CIndy Childrey and myself)
The previous comments concerning Cindy Childrey's message regarding the
confusion within the "Va Gene Magazine" articles, "Abraham "Childers" lll" -
and his surname having caused even more confusion considering his widow Lucy
Thomas [widow of Capt James Neville] carried the married name of "Childrefs"
[Childress] while her last husband is shown in the above articles as
"Childers"? And how is this possible? Would this not have been in error,
the surname being "CHILDERS" rather than "CHILDRES" or "Childrefs" as it was
written during this time in history. No matter how you look at it, it's very
strange! I recall messages on another list several years back. The
discussion was regarding the christian name of "Abraham", the message said
that the name "Abraham" set off an immediate red flag. He went on to say
that this was NOT a CHILDRESS name, but a CHILDERS name. If this is so, why
are so many records found in the CHILDRESS family with the christian name of
ABRAHAM. In fact, the man of whom Joel CHILDRESS was bound to in 1789 Surry
County NC was named "ABRAHAM" CHILDRESS. For those of you who don't know or
have forgotten who Joel was, he was the father of Sarah CHILDRESS, First Lady
who married US President James Knox POLK.
The mention I made at the end of my previous message regarding "CHILDERS"
Australia and the orgin being named as "Childrey England" - Is as follows for
those of you who are interested. When I receive further data I'll let you
know.
MARCH 23, 2002, EMAIL FROM - Mark Lawrence, Senior Librarian, Centre for
Oxfordshire Studies, Central Library, Westgate, Oxofrd OX1 1DJ - as follows -
"Thank you for you email enquiry which was passed to the Centre for
Oxfordshire Studies on 19th March. According to the reference work "The
Place-names of Berkshire" by Margaret Gelling (3 parts, Cambridge University
Press, 1973-6), the place CHILDREY is named from the CHILDREY BROOK which
runs thru it (page 471). The CHILDREY BROOK is itself likely to be named
partly from the Old English personal name CILLA or CILLE, and partly from the
Old English "rith" (the "th" south is really the OE letter eth which looks
like a letter "d" but cannot be transcribed here, which means "stream" (page
8-9).
For the published history of CHILDREY I would recommend looking at the
account of CHILDREY PARISH on pages 272-9 of the "Victoria history of the
county of Berkshire', Vol 4 (1924). The volumes of the Victoria County
History series may well be available in some of the larger reference
libraries in the US; you may wish to inquire locally. Etc etc...
Yours sincerely, Mark Lawrence, Senior Librarian" - END -
AND SEE THIS SOURCE -
http://www.walkabout.com.au/locations/QLDChilders.shtml
CHILDERS - "The centre of the Wide Bay area, the historic town of CHILDERS is
perched on a ridge which overlooks thousands of hectares of sugarcane and red
colcanic soil. To the south there are lush avocado and lychee farms" -
Etc...etc.
NAME ORIGIN - Taken from the village of CHILDREY in Oxfordshire, England -
COMMENT - If the name is "CHILDERS" why would the origin have come from a
placename known as "CHILDREY"? Are these two names intermingled? Are they
one in the same name, perhaps being pronounced and spelt various ways? Why
would Abraham who is the topic of the "VA Genealogical Magazine" series of
articles be called "CHILDERS" when his surname was highly suggested to be
"CHILDRES" - his widow didn't carry the name of "CHILDERS" but of "Childrefs"
[Childress] and it belonged to her husband, ABRAHAM CHILDRES [one S in his
will] - So what gives here?
Has anyone by chance seen the mention also of ABRHAM "CHILDERS" as he is
called in many articles concerning the Childers/Childress families, including
the "Abraham Childers lll" series. This Abraham was said to be of the CURLES
(VA) and there is a deed dated 1656 signed by WILLIAM HARRIS who used red wax
and in the presence of John EPES, Henrico Co VA - From the originial copy the
surname of Abraham is written as "CHILDRES". The SON of this ABRAHAM [also
called ABRAH] was ABRAHAM "CHILDERS" so says the "authorities" - and these
series of articles. But an original deed right here in front of me says that
the above son of Abraham or Abrah "CHILDRES" in 1681 "Know all men by these
presents that I ABRAHAM "CHILDERS" (abstracted) and the original copy says
ABRAHAM "CHILDRES" and "CHILDERS" within the same document., sonne and heir
of ABRAH CHILDERS (abstract) original copy "CHILDRES" decd.
Who is this son called ABRAHAM in 1681? He is the ABRAHAM CHILDRES
("CHILDERS lll" in VA GENE. MAGAZINE) - and whose wife was LUCY THOMAS, widow
of Capt James NEVILLE and who carried the married name of "CHILDRESS" written
as "Childrefs" - And who was his father? The ABRAH or ABRAHAM "CHILDRES"
who had always been referred to as "CHILDERS" - and who had a legal
transaction in Henrico Co VA Record Book 1, Deeds and Wills, 1672-82, pages
199-200. The earliest known date of an arrival of one known by this name.
It would be foolish of me to say that all in America descend from the above
Abraham whose deed was dated 1656. There is evidence that there were other's
arriving or perhaps the same names accounted for several or more times in the
Immigrant lists making us think they were different people, it's possible.
But the fact still remains that here we have a descendant named Abraham and
his name was claimed to be "Childers" and it was "Childres" as shown by his
widow's many legal records.
We all know that America was ruled by the British, there were rules! Rules
which took precedence over everything, even the script of the day. The
Editors of "Childers/Childress Clearinghouse" told me that English law forbid
those in America before the ARW to have or to use double names, have you ever
noticed that? After the ARW we sure did see alot of double names! But we
also see that important wills and other legal documents were burnt up and
destroyed by the British too. Whether or not one's name is Childers,
Childress or Childrey or some other similiar surname.
The issue here is that perhaps the arrival of the first man who carried a
name similar to ours (Childress) was not carrying the name of CHILDERS but
CHILDRES, with one "S". If the English law is as I have read it, it means
that the double "S" was not allowed. If that was so and I believe it to be,
then the "CHILDRES" would have been written just that way. Some have said
that clerk errors were evident in all research, that's certainly true. But
are we to ignore Abraham "CHILDRES" and his 1656 deed with Wm HARRIS and say
it was in error by a clerk? What of his descendants?
Your comments are welcome.
MaryJean Childress Voegtlin
Hi Cindy,
Hi List -
Reference VA Genealogist - "Abraham Childers lll" (series of articles) -
Cindy Childrey's message -
I agree Cindy, with reference to the articles, it's very difficult to sort
thru all the lines when more than a few of them had marriages within their
own branch. A good case in point would be Abraham Childres who married first
Elizabeth Woodson (whose mother was a Cannon), had issue and then married
Lucy Thomas, widow (of his best friend) Capt James Neville. This family had
so many mysteries, the lines crossed. Abraham's daughter Elizabeth married
Lucy's son - Abraham himself was the product of half brothers and sisters
with half aunts and uncles. Ironically enough this Abraham is the one who was
subject of the "Abraham CHILDERS lll" series of articles in the VA
Genealogist Magazine, posted here to the list (see archives) -
Abraham's original will dated 1763, Albemarle Co VA, Probate 1764, Will Book
2, pages's 164-66 has WIFE - LUCY (Thomas Neville) Sons: WILLIAM CANNON
CHILDRES, ABRAHAM CHILDRES, CREED CHILDRES. Five daughters are listed along
with one grandson - Abraham notes HENRY HOPSON [Hobson] as trustee for his
wife, LUCY.
Lucy Thomas, widow of Capt JAMES NEVILLE also left a will - dated 1792
Amherst Co, VA WILL BOOK 3 - One daughter is named Martha HOBSON. What
amazes me is if the VA Genealogist articles titled this series "Abraham
CHILDERS lll" and they say he WAS a "Childers" then how is his wife a
"CHILDRESS" - Proved by her WILL and all these census records and court suits
involving her family. Also the Neville papers produced in court. This is a
typical example of certain researchers labeling a surname spelling and it is
repeated. Such could be said for those with other variants. As for
Abraham's (lll) WILL - His name was clearly written by the clerk as
"CHILDRES" - Lucy, his widow had both "Childrefs" and "Childres" -
The Thomas "Childers" who left the Henrico 1734 Will (from original copy),
his wife was Mary. One noted researcher said he was married to Mary "Cannon"
while he was also said to have married perhaps twice and to another Mary last
name unknown. Another had this Thomas married to Mary Hobson. While within
my husband's Hobson family, there are three proven marriages with
Childers/ress and one which is suggested, that of John Hobson (1771-77
Cumberland Co VA Will) who was to have married a Sarah Childers/ress. And
then we have Lucy Thomas Neville Childress's "son-in-law & Trustee" Henry
Hobson who married her daughter (per Abraham Childres will and Lucy's will,
also Chakley's Chronicles and court records).
The HENRY you speak of was suppose to be the son of Abraham "CHILDERS" Jr.,
from the 1793 original copy in Henrico Co VA - We see his sons ABRAHAM,
PHILLIMON, JOHN, ROBERT and HENRY whose Will dated 1727 Henrico pages 131/32
lists sons THOMAS and HENRY (Sr) Father of the same HENRY (Jr) who migrated
from Chesterfield Co into Lunenburg Co VA and left the 1761 WILL - All of his
children were known as "CHILDRES or CHILDRESS" - Some early NC deeds refer
several of his sons as "Childers" but in the same deed we also see,
"Childrefs" - A known son was JOHN who was JOHN Childress Sr of Nashville TN
- Evidence supports the surname spelling of Henry Childers/res. Jr's issue.
What of his son named THOMAS? What happened to him? Could he be Thomas
known as Childers/Childres and Childrey who left the 1756 Henrico Co VA WILL?
We have seen many Thomas's in VA and whose descendants migrated from VA to
many southern states -
What of Thomas "Childers" and the 1734 Henrico Co VA WILL? His wife is known
in this will as MARY - Was she a Cannon? Or perhaps was she the HOBSON of
whom many researchers believe she was? What of his son Thomas? Was he the
one who left the 1756 Henrico Co VA WILL? Clerk records have spelt his name
as Childers, Childrs, Childrey and Childres. What of his son named THOMAS?
According to the Immigrants list - (Childers/Childress Family Association,
INC) we see a THO CHILDRES 1667 - THOMAS CHILDERS 1674 - THOMAS CHILDREY with
no date, Patent Bk 9, Honble Edmund Jennings rec'd 3490 acres, Ing Wm Co for
trans. 70 persons, THOMAS "CHILDREY" was one of those. (CALALIERS and
PIONEERS, Nell Marion NUGENT, VOL 3, Page 81)
Were there Thomas Childers/res/rey who were actually the same man? Who
travelled back and forth to gain property along with a wealthy landowner?
Was this done with these Thomas's as it is suggested with the
Philemons/Lemons - Both shown as "Childers and Childres" -
Recently my husband's relative Dr. Arthur Smith who is with Oxford University
in England wrote to tell me of "Childrey Brook" in Berkshire, England. He's
making me copies of the information and I should receive them soon. But in
the meantime, he also informed me of a placename called "CHILDERS" Australia
- I contacted the web address he gave me, he was correct. They told me the
origin for the place called "CHILDERS" Australia was "CHILDREY" England.
If any listers would like to comment, please let us hear from you! Thanks
Cindy for your comments!
MaryJean (Childress Voegtlin)
Hi List,
I just wanted to say the Virginia Genealogist papers
she wrapped everyone up the best she could and tried
to sort the lines out. Jeremiah she said was the son
of Thomas - Thomas- Philemon while Henry was the son
of Henry-Thomas -Abraham but yet both lines ended up
in Charlotte. With the Va Genealogist she leaves no
room for others coming into the country. I still have
doubts that Thomas who died in 1758 was the son of
Thomas who died in 1735 son of Philemon. What I
wouldn't give if they would have said where their
plantations were located in their wills it would have
make sorting the lines easier. Because Henrico County
was the home base for everyone to start that is where
I am researching now.I'll post if I find out who owned
the plantation before Thomas Childrey who died in 1788
to me that will answer alot of questions. Cindy

Hi list,
Recently, Cindy Childrey posted a message regarding Benedict Childress and
she had asked about this branch in Charlotte Co. VA - Please see CR-List
messages April 26, 2002 (Cindy Childrey) and April 27, 2002 regarding
"William Childrey in Charlotte Co VA -
Cindy asked about the other branches - and those being Jeremiah (see the info
in my message dated 4-27-2002) also Benjamin, Robert and HENRY** - Thought to
follow up with additional info for Cindy and list members as follows - Some
of whom were in Lunenburg before parts were carved to make Charlotte Co VA
1765c -
**HENRY -
The earlier info in message dated 4-27-2002 was in regards to the man known
as HENRY CHILDERS/res - His will was dated/signed December 21, 1760. For an
online abstract, see - (http://www.tlc-gen.com/Lunenburg/WillBook1.cfm) -
"Lunenburg County, VA WILL BOOK I, With Inventories, Accounts, Etc, 1746 -

publisher - Dr. Bob and Jo Ann Childers - email - (Bob265617(a)aol.com)
From the WILL of Lunenburg Co VA, Parish of Cornwall, signed Dec 21, 1760,
HENRY CHILDERS and wife MARY [shown to have been FARMER] - (Surname spelling
seen as CHILDRES, CHILDERS, CHILDREY) in the original copy of WILL -
SONS -
Jno CHILDRES
Henry CHILDERS
Thomas CHILDRES
"To my children, JOHN, LUCRESHA, PHEBIA, ANNE, HENRY, THOMAS, MILLICENT,
MARY, GODFREY, SARAH and DAVID.
Executor, Paul Carrington (good friend)
Witnesses - Wm Goore - Wm Mullings and THOMAS RUTLEDGE"" [see below]
******************************************************************************
********************
**THOMAS RUTLEDGE - This person was also seen signing a "Memorandum" for
HENRY "Childrefs" - Original copy sent to me from Cindy Childrey - Cindy pls
confirm the book please, if you have that information - But I believe the
book is as follows - "CHARLOTTE Co., VA DEEDS, BOOK 4 1777 - 1782 - I will
but note the names and content -
(Page 8) - "Memorandum - named, HENRY "Childrefs" unto the within named
ZACKARY DAVIS*** to hold to him his heirs and assigns forever according to
true purpose, intent and one naming of the within INDENTURE in the presense
of JAMES, his mark (X) RUTLEDGE**, THOMAS RUTLEDGE and CHARLES BIAZLEY (sp) -
HENRY CHILDRES LS" -
"COURT held for Charlotte County, the 5th day of May 1777 - The within
writtin INDENTURE and MEMORANDUM hereas Indorsed was by the three Witnesses
subscribed to be the act and DEED of the said HENRY "Childrefs" and to be
recorded - Test - Thomas READ C " -
NOTE - To the left of the original copy is half the afore mentioned legal
document which has the names of HENRY "Childrefs" - His surname is clearly
readable in the copy I have and also the above. It is suggested that the
THOMAS RUTLEDGE above as witness was also witness to the WILL signed 1760 by
one HENRY SR who I believe was certainly the father of the above HENRY
"Childrefs" in the MEMORANDUM and DEED.
The Completion Papers of WILLIAM CABLER MOORE - He gave the exact information
regarding HENRY Childers/ress who left the Lunenburg Co VA WILL - and his
issue - One being JOHN CHILDRESS who first married Elizabeth Armstrong [daug
of William ARMSTRONG who left a will naming son in law JOHN] and then Nancy
Ann Hickman - Living in NC, migrating to Nashville TN - The series of
articles I am now writing concerning THOMAS CHILDRESS of Lauderdale AL and
previously TN is from this same family. It would certainly be suggested the
above HENRY would also be from the same family. DAVID Childress son of Henry
Sr was also said to have migrated to NC, perhaps to SC and then to TN. He
could be the one whose family is described in letters of the GAINES family.
Later, I hope to post the information I've located in regards to two
Childress families who intermarried. One being David Childress the other
being William Childress. Both who settled in TN.
***ZACKARY DAVIS - of whom is in the above document with RICHARD "Childrefs"
[Childress] - I can't confirm that Zackary DAVIS is of this family - However
- "Childers/Childress Clearinghouse Research Bulletin, Winter - 1999, Pages
105 - 130- as follows -
PAGE 109 - Dr. Jones received data from Ms Sharon Brakefield - "McCubbins
Collection, Knoxville TN" -
1798 - June 9 - Marriage Bond - JUDEA CHILDRESS to SAMUEL DAVIS, signed by
Thomas HARPER - [Aunt of Samuel CHILDRESS?]
PAGE 110 -
1800 - August 09 - SAMUEL CHILDRESS aged 16 years, a child abandoned by his
father, is bound to SAMUEL DAVIS to learn the trade of a joiner and carpenter
and at expiration of his term to receive twenty dollars worth of tools.
NOTE - The above information came from SURRY CO, NC according to the data
received from Dr.John Rison Jones, JR for publication in "Clearinghouse" -
Could the above DAVIS family be related to the ZACHARY DAVIS whose name
appears in the document with RICHARD "Childrefs" above?
FUTHER NOTE -
Cindy Childrey also sent me the original copy of a deed dated October 5th,
1778 also in CHARLOTTE CO, VA - names in the deed were RICHARD "Childrefs"
and JOHN "Childrefs" - The names are clearly spelt, however the content of
the deeds are difficult to read. However, what I could read is that RICHARD
"Childrefs" was living in Charlotte County, VA at least by 1778. The
Indenture suggests that JOHN "Childrefs" was also living there. Other names
in this Indenture were - HEZ. COLEMAN - JOHN CROCKETT - with JOHN "Childrefs"
in presence.
There were other CHILDRESS's and variants living in Charlotte before the ARW
and during the war as was SUSAN "Childrefs" wife of Continental Soldier,
BENJAMIN "Childrefs" - Sarah Childress Polk so stated in the 1890 letter (see
my post, 2000, Childress-Research-List archives) when asked if she recalled
any family tradition regarding her Childress family, she said no. She then
said that her father's mother was "SUSAN" and that her sister had been named
for her father's mother named "SUSAN" - Sarah CHILDRESS Polk, First Lady of
President James Knox POLK had a brother who died in infancy, BENJAMIN W.
CHILDRESS -
There are other Childress's - Childers and Childrey's of whom we are unaware
of who lived in Charlotte Co VA after it was carved from Lunenburg Co VA
1765c - But the above original copies help to clear the way for who was there
during and before the ARW. Anything you would like to add Cindy would be
welcome - If any of you have any questions or comments pls ask!

Hi Cindy -
Hi List -
Ref: Peggy Howell - and Guardianship of minors -
Thanks for the additional information Cindy, please also see the post by
"Kay" regarding this same Howell.
You mentioned Jeremiah, Henry, Robert and Benjamin in your message. Do you
refer to the Robert who seems to be in only the Lunenburg Co VA Tithes? I
have record of him being listed in those records (clerk) as Childers and
Childrefs along with Childrey. I assume you mean Henry Childers/ress who
left the 1761 Lunenburg Co VA Will. A known son of he and Mary Farmer was
John "Childress" who migrated from VA to Surry Co NC - married Elizabeth
Armstrong dau of William Armstrong who left a will naming him. John Sr is
the one who is on record in Nashville TN and left the 1811 Will (see
Childress Research-List archives) - John Sr's family is well known, having
produced son, John Childress Jr whose son was George Campbell Childress,
author of the Texas Declaration of Independence. Many of the sons of John
Childress Sr settled in NC - SC and TN - I can't really speak for Benjamin,
except to say that there was an earlier Benjamin whose estate was settled in
1779 and whose name was spelt as "Childrefs" - There were many
Childress/Childres who enlisted in the ARW out of Charlotte (carved from
Lunenburg Co 1764c) who are unaccounted for. One being Richard Childress of
whose deed you sent me. He might have been the Richard who migrated to NC
and thence to SC. But there was more than one Richard in that part of VA as
you know!
As for Benjamin mentioned in Jeremiah Sr's will. I have not found a great
deal about him. He and William both paid the bond along with Jane (widow of
Benedict) for the guardianship papers for her minor children. Here is
something further on the law at the time reference a parent who dies with an
estate such as Benedict's.
GUARDIANSHIP for MINORS -
For instance, a 20 year old orphan in the 18th Century would have needed a
guardian because under the common law anyone under the age of 21 was deemed
an "infant" and an infant was incapable of entering into binding contracts.
(per an attorney relative) -
From the Library of VA - Archives Research -
When an individual acts as a trustee for another, the relationship is
described as a fiduciary one. The protection of inherited property (both
real and personal) was an important reason for the creation of court records.
When minor children survived a parent, a guardian was often appointed to
protect the estate for the children. Appointments of guardians are recorded
in the county court order books. A guardian was appointed by the court only
if there was an estate to protect. At age thirteen, a child was eligible to
to into the court and choose his own guardian. Poor orphaned children did
not have guardians and were bound out to learn a trade. Periodically
guardians were required to bring estate accounts into court. These were
often recorded in volumes known as guardians accounts. The estate of a
deceased person with minor children required the keeping of records (estate
or fiduciary) until it was settled. -
I know that Benedict Childress had a nice estate so therefore, I am sure that
his wife Jane being the widowed mother had to have bond set which it was.
Her children were very young at that point (1794). None of these children
were bound out. Once, some of the children reached maturity, a daughter was
married and Thomas Hamblin who married Jane second after she was widowed, was
shown in the marriage record as "Guardian" for her, as he was her step-father
at that time. I believe that although the mother is alive, the minor
children still by the laws of the 18th Century required a guardian for their
interests and that suggest the estate of Benedict, their father.
If anyone else can provide a better explanation, please let us know. Thanks
Cindy for your comments, always welcome -
MaryJean
Reference - Guardianship for minor or "Infants" - Regarding JANE Childress,
widow of Benedict (Richard?) Childress of Charlotte Co VA -
Hi Cindy -
Hi List -
It's my understanding that any young person (children) of a deceased father
and in this case it was Benedict Childress - These children were called
"infants" until they reached the age of 21. So it's my understanding that
all five of the children listed in the guardianship papers needed a
"Guardian" because they were under 21 years old. Even tho their mother was
alive and well. I had found the same situation with John Hobson (my
husband's ancestor) his children (those not married), some were teens and in
order for any of them to marry and etc, they needed guardians, which they
found...because by VA law, they were considered "infants" - The exact wording
for this law regarding "guardianship papers" I'll look up in my records and
repeat for those here who have had similiar questions regarding underage
children. Hope this helped! Thanks for the additional info Cindy.

An extract of the introduction from Paul Heinegg's book, "Free
African Americans of Virginia, North Carolina, South Carolina,
Maryland and Delaware." Following the introduction is a
5-generation genealogy of descendants of Elizabeth OWELL or
Martha HOWELL, one of whom is suspected to be the mother of
Dorothy HOWELL.]In 1691 the Assembly prohibited the
manumission of slaves unless they were transported out of the
colony. It also prohibited interracial marriages and ordered
the illegitimate, mixed-race children of white women bound out
for 30 years [Hening, Statutes at Large, III:86-87].

8. Peggy Howell, born ABT 1774, a "Mulatto," was living in
Charlotte County on 7 April 1794 when her daughter Peggy
Howell was bound to William Childrey [Orders 1792-94, 174].
She was a "Free Negro" head of a Charlotte County household of
8 "other free" in 1810 [VA:1002]. Her child was Peggy, born
ABT 1792.
Hi List,
On the page before I posted Peggy Howell was listed as
a mulatto and her mother bound her out to William
Childrey (I would guess as a servent) and then she
quickly changed her mind. As for Jeremiah, Henry,
Robert and Benjamin the early Childress
/Childrey/Childer in Charlotte Co Virginia somehow in
later generations there became Childrey and Childress
and Childers living in Charlotte and I don't believe
they came from other areas but from the original four
so they could not all have been Childress were they
the same family who liked to change the spelling of
their name(or the clerks?) Many of them left for other
states and the ones who are there today I don't
believe they know who they descend from.(this is my
experience of the Childrey line) I am still trying to
sort them out in Henrico County by where they lived
thing is they lived close together and married into
the same families. What I hope to find is where
Philemon and Abraham original land was and who ended
up with it. Mary Jean why would Jenny have to be
appointed as guardian of her own children? Cindy Childrey

Hi Cindy -
Hi List -
Reference - Message dated April 25, 2002 - Magazine of VA Genealogy, Feb
1988, VOl 26, #1, page 13 - Regarding "Charlotte Co Order book 10, 1794-96" -
and also "Jenny Childrey appointed guardian to William, Betsey, Sarah, Jesse
and Nancy Childrey orphans of Benedict Childrey" -
Nice to see you post once again Cindy! As you know, I've sent you original
documents regarding my line of Childress, not all, but some of them. You
have this information, but for those who are new subscribers and for those
who wish to know, this is what I have on the above taken from these sources
as follows -
1) PEGGY HOWELL -
According to what I could locate in my files. Peggy Howell - Howel appeared
in the 1810 Charlotte Co VA Census - 1001 - 53/11 as - HOWEL, PEGGY (FN) - 8
Free Negroes. Not actually seeing the above original document, I would have
to say that it's suggested that she was most likely binding her daughter
"Peggy" out for some type work? Those here can correct me if this is way off
base. Also in the 1810 Charlotte Co Census was a HOWEL, Winny - 971/68/5
aged 45 years old. No mention that she was a free Negro (RN) - So I would
say not.
2) Regarding the next entry you posted. Guardian, "JENNY" and children -
According to the original documents (copies) with additional book records I
have on this family, here is the following information - Additional comments
in brackets.
A) "WILL BOOK !, Page 440 - JEREMIAH CHILDRESS SR, dated, 20 Nov, 1790,

C) The variants used by Clerks for this family were "CHILDERS", "CHILDRES",
[Childrefs] "CHILDRESS" and some "CHILDREY" -
JANE CHILDRESS, widow of BENEDICT, also said to be named "RICHARD" - was
often referred to as JANE and JEAN also nicknamed JENNY as per the
guardianship papers in Cindy's post. My name is "MaryJean" and my name has
been written as "MaryJANE", JANE, JEANNIE, JENNY" - why? Typical of the name
JEAN. I have to correct people all the time, so I can understand the various
other "names" for JANE CHILDRESS widow of Bendict also said to be named
Richard Childress. However, her name was JANE I believe due to the evidence
in more than one original document. Her deceased husband's surname was
referred to as "Childres, Childrey, Childress [spelt Childrefs] and Childers,
[Clerk records]
JANE was the Executrix of the Estate of Benedict Childress and accounting was
filed in both Mecklenburg and Charlotte Co's in VA as follows from the
original copy of the document -
"CHARLOTTE CO VA INVENTORY PAPERS" Recorded DB 3, Page 246 - as the following
-
"1794 - De Estate Benedict Childrefs [Childress] in account current with
Thomas Hamblin and Wife, former JANE Childrefs [Childress] Executrix - Thomas

NOTE - Jane Childress married 2nd per Mecklenburg Co VA Marriages (Don
Crutchfield) as follows - Thomas HAMBLIN and JEAN CHILDRESS, 10 Nov 1803,
Balaam EZELL Sec.
Thomas HAMBLIN was also my ancestor thru his daughter Elizabeth HAMBLIN who
was widowed [John Mayes 1800 Will] and who married 2nd Rev Balaam EZELL SR
and whose daughter was Zelphia who married THOMAS CHILDRESS, son of WILLIAM,
son of BENEDICT and JANE who married 2nd Thomas HAMBLIN -
Thomas HAMBLIN left an 1811 WILL in Mecklenburg Co VA - Son of JANE listed as
JESSE Childres - Purchasers were WILLIAM CHILDRESS and JESSE CHILDRESS, both
sons of Benedict (Richard?) Childress and JANE.
A Prenuptual agreement was made between THOMAS HAMBLIN, widower [first
marriage to Elizabeth SEAT] and JANE "CHILDERS" [Childress] Mecklenburg Co VA
Deed Book 13, Page 232, Dated June 8, 1807, Original copy in my possession.
JANE's deceased husband was referred to in this document as "RICHARD"
Childress.
Guardianship papers has the Securities from JANE and WILLIAM and BENJAMIN
CHILDRESS - as seen above.
D) Mecklenburg Co VA Marriages include the following with reference to the
children of Benedict and JANE Childress -
John OVERBY, MB, June 11, 1804 to ELIZABETH CHILDRESS, Surety, William
OVERBY, Consent JINEY [JANE] CHILDRESS, mother of Elizabeth - [daugh listed
above in guardianship papers]
Anthony GREGORY, MB, January 6, 1814, Marriage January 8, 1814 to NANCY
CHILDRESS, Minister Reuben Pickett, Surety - WILLIAM CHILDRESS [I believe
this to be her brother shown in above guardianship papers]
Baalam EZELL Jr. MB Dec 14, 1808 to SALLY [Sarah] CHILDERS [Childress]
Surety, Balaam EZELL SR, Consent: Thomas HAMBLIN, Guardian who stated that
SALLY is underage. [Thomas Hamblin married Sally's mother 2nd]
JESSE CHILDRESS married Lucy JACKSON in Mecklenburg Co VA and WILLIAM
CHILDRESS [brother of Jesse} was the Surety.
A WILLIAM CHILDRESS was also Surety for the marriage of Coleman VAUGHAN or
Vaughn MB dated Dec 18, 1833 between Coleman and Elizabeth CHILDRESS.
E) WILLIAM CHILDRESS son of Jane and Benedict [Richard?] Childress was born
according to his tombstone, Oct 14th 1785 and died Nov 8, 1864 Caldwell Co
KY. There has been no marriage record found for William. However recently,
a Will was located for the father of his wife, NANCY WILKERSON which lists
her as CHILDRESS. There is other proof which backs this up in other
Wilkerson data.
F) From the original census records for Mecklenburg Co VA - William is listed
as "Childrefs" in 1820 with 5 children and wife. His mother JANE is living
next door. The original census also showns William for 1830 with 9 children
and wife, also living in the HH is his mother JANE CHILDRESS HAMBLIN, whose
widowed.
G) William CHILDRESS migrated to Caldwell CO KY between the 1830 and 40
Census for Caldwell Co KY - He appears there with his wife NANCY as William
"Childrefs" - his son Thomas is also two doors up in this census, also living
next door was a Richard Childress who some project as son of William and
Nancy Childress. William Sr and wife Nancy show in the 1840 - 1860 Census's
for Caldwell.
H) SEE Message dated Fri, 29th Sept 2000, "William CHILDRESS JR Bible
Records" - Childress Research-List archives - This would be the Bible records
of the son of William and Nancy Wilkerson Childress of VA and Caldwell Co KY.
I) Caldwell Co KY Will of Major Groom dated Nov 17th 1842, as as witness -
WILLIAM CHILDRES - Proven Feb Term 1846 by oath of WILLIAM "CHILDRESS".,
Taken from "Caldwell Co, KY Will Book B" [Brenda Joyce Jerome -
http://www.ctaz.com/~firefly/major.htm -
(J) While I have other documents with my ancestor's names spelt as
"Childress" with some spelt as Childers - The most important record I own
is the following original document -
"WAR of 1812 APPLICATION for BOUNTY LAND- Dated 23rd August 1856 -
"I William Childrefs a resident of Caldwell County KY aged seventy years do
make the following statement. I am the identical William Childrefs who was
private in a company commanded by Captain Richard Daily in the Regiment of
Virginia drafted Militia commanded by Col. Burns in the service of the United
States in war with Great Britian, declared 1812. I was drafted in
Mecklenburg County, Virginia on or about the 7th day of August A.D. 1814 to
serve a termm of Three months than 14 days and was honorable discharged at or
near a place called Camp Powells Creek Virginia on (or about) the 20 day of
December A.D. 1814 as will appear by reference to the rollos of the
Department. My discharge was burnt up in my house with other papers so that
I cannot now return it.
Witness my hand in Caldwell County in the State of Kentucky on this the 23rd
Day of August, A.D. 1856 - signed - "WILLIAM CHILDRESS" - Witnesses were
George M. Jackson and relative Mary Blanks. - James C. Weller, Clerk., J.
Newt Turner, whose signature was stated was genuine for the above certificate
was at the date thereof sole and presiding Judge of County Court..Witness my
anem and official seal at my office in Princeton KY, August 23, 1856". end
NOTE - The children of William and Nancy Wilkerson Childress are on record in
TN and KY - I have copies of marriage records for all of them. Their surname
was generally spelt as "Childrefs" [Childress] with some references by clerks
as "Childers" - Thomas Childress son of William and Nancy Childress - I have
never seen any reference to he or his siblings as "Childrey" but rather
"Childrefs" and several entries by clerks as "Childers" - Thomas Childress
[my ancestor] is seen on the Childers/Childress Civil War Site (Jack
Childers) under Ky Childers/Childress Civil War Men - THOMAS CHILDRESS, 1st
Inf - Co K - [CSA out of KY] He died in Robertson Co TN after the 1870
Census and left issue.
I have other documents, but I believe this will give you an idea of the
family and the various documents regarding the spelling of their name. I do
not know of any descendant of this branch with the surname spelling of
"Childrey" and have not seen it in my branch while in Mecklenburg Co
Census's/records or in KY in the orignal records, several "Childers"
references, but mainly "Childress" Let me know if any of you have any
questions or comments, their welcome!

In the 1700s and early 1800s, it was common for court clerks
and others who were recording local residents, such as on tax
lists, to find a way of distinguishing between two or more men
sharing the same name. "Sr." and "Jr." was an easy way of
solving this problem even when the two men so identified were
not father and son. Because there was one, and possibly two
other men in Knox Co. who shared the name of Robert L., this
may have been why the Robert L. who married Hannah in 1832 was
recorded as "Jr." on his marriage license because another,
slightly younger, Robert L. had married in 1830, just 2- years
earlier.
