Knox County Court July 7, 1859 Session
A paper purporting to be the last will & testament
of John Childers
was produce in court and proven by the oath of the
Subscribing witnesses there to P.J. EArnest &
Marlin Roark and order of record ( as follows
In the name of God Amen, I John Childers
of Knox County and state of Kentucky, being of
sound mind and memory and considering the
uncertainty of this frail and transitory life, do
therefore make and ordain, publish & declare this
to be my last will & testament, that is to say
First after all my lawful debts are paid, and
discharged the residue of my estate, real &
personal, I give and bequeth and dispose of as
follows ) to wit, To my wife Elizabeth during her
natural life, all my land and personal property
and after my said wife's death, the land to be
divided between my two youngest sons, Alford
Childers and Elias Childeres, as follows, I give
and bequeth unto my son Alford , ten acres of land
adjoining the land that I deeded to him on the
first day of this instant (July) The balance of
the land I give and bequeth to my son Elias & I
give & bequerh unto my daughter Martha Childers
all the personal property that will be remaining
at my wife Elizabeth's death. In witness where of
I have here unto subscribe my name and affixed my
seal this seventh day of July 1859.

It appearing to the court that Drury N.
Childres,Josiah Childres,James Childres and
Barbary Childres are material for the deponents in
the above stated cause and that they reside
without the limits of the state of GA viz in the
county of Pike and State of AL so that the
compulsory process of this court cannot be
rendered available in requiring their
attendance in this court to give evidence in said
caus. Manifest injustice to force the said def't
to trial without giving them as fare as possible
the benefit of the testimoeny of said witnesses.
Is There for on motion of counsel for said
defendants ordered that the
testimoney of said Drury N. Childres, Josiah
Childres, James Childres and Barbary Childres be
takened by interogatories as in usua in civil

Ref - Thomas CHILDERS who married Mary CANNON in your message? Would you
have any other sources for this marriage? I also have Abraham as having
married Elizabeth CANNON and she connects to WOODSON and MOSBY. Also
interesting to me is the fact that this Abraham was the spouse of LUCY THOMAS
NEVILLE who married as a widow to ABRAHAM, widowed - All of the sources I
have, including the original copy of LUCY's will have her married name as
"CHILDRESS" - Her son in law was HENRY HOBSON - whose ancestry connects to my
husband's HOBSONS of White Oak Swamp in early VA records - who later resided
in Cumberland CO, VA.
Anything you can share regarding these surnames would be appreciated. I have
alot of proof with sources regarding LUCY and her husband ABRAHAM who has
been referred to as "Childers" - However, his descendants were "CHILDRESS" as
was his widow, LUCY THOMAS NEVILLE CHILDRESS -

living in fidelity to the Quaker testimonies of
peace, integrity, simplicity, and equality;
bearing witness to God's loving ministrations to
the heart and soul of each one of God's children.

along with the distinctive outlook on life Friends
possess-how does one measure the difference in the
quality of life that would result for the rest of

John Hughes was a good citizen. He served on
juries many times, was
appointed tax collector for 1786. He was put on a
jury by the court "to mark out a road if necessary
from Virginia line near Webbs to Rockingham Co.
near Abraham Martins in May Court in 1788." He was
later ordered to view a road, the "nearest way"
from a place in old Virginia to a road by the name
of Chandler's Burnt Cabbin to VA line where it
crosses old road between John Childress and
Archelus Hughs, May 1788.
