Tom F. Cheek was my grandfather. He passed away in June 2004. He had a son (my dad) and twin girls. The family lived in Pensacola Fl, but he moved to California when he divorced my fathers mother. He was a Naval pilot. He did the research on the people you are searching and got back to Sarah B.

I expect that the court would have been aware of this at the time. Why did they not call it out but rather accept it during the proceeding? I believe that the answer lies in the interpretation of the town's name. Present day Front Royal had two different names before coming to be known by its present name. Local explanation for the name indicates that the term "front royal' probably applied to a vast area of the frontier [ notice the term "front" within that word] where the Brits were actively engaged during he French & Indian War. The present town of Front Royal was formally chartered by its present name about 1788, if I recall correctly. I have treated this testimony as I would an individual referring to Wheeling, West Virginia when actually it might have been Wheeling, Virginia, or perhaps even Wheeling, Pennsylvania.

Some time back I read that a large number of people came into Virginia from Maryland when they first started opening up land in the 1700s. So I am curious about this little tidbit I came across, where a George Cheek was sentenced to be transported to either Virginia or Maryland from England, a number of them winding up in Middlesex, VA. Here is the text, from pp. 92-93 of *Land Records of Prince George's County, Maryland, 1739 - 1743* By Elise Greenup Jourdan (asterisks around George Cheek's name are mine),

Should point out that there is a Middlesex County in Virginia that was officially formed in 1669. The timeline for this is right for this George Cheek to be the ancestor of someone, including the Dearborn County Cheeks. He would have to be the father of George Cheek of Front Royal, VA or of the Francis Cheek whose two sons married into the Horton line.

Hi all, when I originally made the preceding post, I got some things turned around.
I wrote, "The Elijah Cheek unrelated to George and Leanna married a Mary Holtzmann. It should be noted that "Polly" is a common nickname for "Mary" and in the link above Polly Cheek is mentioned more than once as the wife of E. Cheek.

The above is incorrect. It should be the other way around. It should read,

"This Indenture made and entered into this 3rd day of April 1847, between E. Cheek and Polly his wife of the one part and Austin Cheek of the other part. Witnesseth that the said E. Cheek and Polly his wife for and in consideration of the sum of fourteen hundred and sixty dollars to them in hand paid by the said Austin Cheek at or before the ensealing and delivery of these presents, do bargain and sell unto the said Austin Cheek two tracts or parcels of land, which formerly belonged to George Cheek, deceased. The one tract is known by the name of the Fork tract, and is supposed to contain 145 acres and is bounded by the land of Wm Rudasilla deceased, and the road leading from said George Cheek, deceased, Mill towards Washington and the land of Lewis Fannell. The other tract is the tract which George Cheek deceased got as his portion of his father's land and is the same on which James Cheek deceased formerly lived and is said to contain fifty acres, together with all and sing!

Francis Cheek, son of George Cheek of Front Royal, VA, and his wife Mary Kiggins have, according to some sources, several sons, one of them named Elijah Cheek, who is married to a Mary "Polly" Holtzmann. This Francis Cheek and Mary Kiggins also have a son named George Cheek, and a son named James Cheek.
This Francis Cheek and Mary Kiggins being descended of George Cheek of Front Royal is not fixed in stone. There appears to be some confusion over which Francis Cheek is which in that general area of Virginia, and no one right now as far as I am aware really knows just who is who.
Elijah Cheek, son of Francis Cheek and Mary Kiggins, was born, according to online genealogies about 1798, but there is no source material for this given in these online genealogies. That would make him too young to be the father of Austin Cheek, though. So we can rule that out, unless the date is incorrect, something which cannot be ruled out due to the lack of citation of sources.
But as things currently stand, it looks like this Elijah Cheek and Austin Cheek had more than casual aquaintances, but were not father & son.

This is my line also. Austin and Amanda or Demanda (Whalin or WHALING) were my ancestors through their son James Cheek and Rebecca Cox. I have alot of deeds which document their lives. But as all here mention, there is no smoking gun to prove paternity of Austin. (I believe that marriage record is the only place he is listed as Oscar.) I will share any info I have in order to try and discover which Cheek line Austin came from. I'm sure he is related to Elijah Cheek but could have been a nephew as easily as a son.

Problems with stated genealogy of one of the Dearborn County Cheeks in the Cheek DNA tests.
For James Cheek, b. 1788 and living in Decatur County, Illinois, and said to be the son of George Cheek of Front Royal, VA, we have two serious problems:
1) Most of the family genealogies of George Cheek and Leanna of Front Royal, VA, have James Cheek being born about 1860 years or so earlier. However, no original source material is given for this in these genealogies. However, Eula Marie Holtze Brown, in her book *Parks Family History*, has the James Cheek, son of George Cheek and Leanna as a Colonial Corporal in the Revolutionary War. This would place him as having to be born roughly 1760 or earlier. She also has him dying in Nov. 1845 in Virginia.
2) Also, The 1850 Census for Decatur County, Indiana, that shows the James Cheek, b. 1788 that is listed as the son of George Cheek of Front Royal, VA, in the DNA study, has his as "Elizabeth". However, the existing genealogies have James Cheek's wife as Ruth Dawson. There is also a possible second wife for the James Cheek, son of George Cheek, of Katy LNU according to two sources (one a marriage bond for their daughter, Nancy Cheek to an Adam Miller), but this is not the James Cheek of Decatur County.
A better fit with less problems would be to have the James Cheek of Decatur County, IN, be the son of James Cheek and possibly this second wife Katy, as Ruth Dawson is reputed to have died in 1774, but there are no original source records for this. This is speculative at this point, as there is no proof that they had a son name James who was born about 1788, though. But the assumption that the James Cheek of Decatur County, IN, born 1788 in VA to be the son of George Cheek of Front Royal appears to be incorrect, unless there is a completely undocumented son born to George Cheek and Leanna between Nelly Cheek and Tavner Cheek.
But I think it would be more likely that the James Cheek of Decatur, IL born 1788 to be a grandson of George Cheek of Front Royal, VA, because it is looking rather difficult for him to be a son based on current information.

More information supporting the fact that Austin Cheek of Rappahanock County, VA, was also known as Oscar Cheek (whether "Austin" or "Oscar" was a middle name, or a nickname I could not say).
