acres of land to be taken off the above described tract.
To my son, John W. Cavitt, 500 acres of land to be taken off the above
described tract.
To my two daughters, Martha Ellen and Leah D. D. D. Cavitt the house
and lot upon which I now reside, also to each of them, 230 acres of land
off the aforementioned tract of land.
To my two sons, James Alexander Cavitt and Andrew Jackson Carroll Scott
Cavitt., 40 acres of land which was patented to James C. Fancher,
purchased by G. H. Lanier from said Fancher and by me from said Lanier.
(On Duncan Creek near Athens, Texas, 640 acres in the one-half Moses
Cavitt Colony certificate.)
THE MOSES CAVITT WILL:
In The Name of God Amen
I, Moses Cavitt of the County of Henderson and State of Texas, being of
sound mind and , memory and considering the uncertainty of this frail
and Transitory Life Do therefore make and ordain, publish, and declare
this to be my Last Will and Testament that is to say first after all my
Lawful debts are paid and discharged the residue of my Estate Real and
personal, I give bequeath and dispose of as follows., to wit: To my
beloved wife.. Susan, during her natural life and her bodily heirs after
death one negro boy named Charles, some twenty two or three years old,
yellow complexion., one Negro woman named Rose, fifty years old, black
complexion., also four horses and a mare & colt, also one Carry-all,
also all the farming tools, and a set of Black Smith Tools, also all the
Stock of Cattle and Hogs,, also all my stock of Sheep, consisting of
nine head. Also one note which calls for cash of John Wofford, payable
to me, Due January the first A.D.., one thousand eight hundred and fifty
three which calls for eight hundred dollars, also one note on Jessie
Duren due the first day of September A.D., one thousand eight hundred
and fifty-two. To my beloved Daughter, Margaret Jane Wren and to nv son
Canada Cavitt, I give grant and bequeath to each one the sum of ten
dollars each, the above named heirs being children of my first wife
Elizabeth (now deceased).
Also, to my beloved Daughter, George Ann Mary Elizabeth Cavitt, Mosettia
America Jane
Cavitt , Martha Ellen Cavitt, and Leah Docia Derotha Dulcena Cavitt.
And also to my sons
Richard Dudley Brooks, John Wesley., James Alexander, and Andrew
Jackson Carroll Scott Cavitt, I give and bequeath and set apart to each
one the sum of ten dollars all the above mentioned property and Estate I
am lawfully possessed.
Likewise, I make constitute and appoint my wife, Susan, to by my
executrix of this my Last Will and Testament.
In Witness whereof,, I hereunto set my name and affix my seal (using
scroll for seal) On this the second day of March A.D., one-thousand and
eight hundred and fifty-three.
