Randy, do you know if this was the will of the emigrant
Moses, or his son, perhaps a nephew? I believe son
Moses was in Sumner County, TN by this court term.

Moses Cavett
Be it remembered that I Moses Cavett of the County of Knox and State of
Tennessee being at present of sound mind and memory do make and ordain my
last
Will and Testament as follows to wit. First My Will is that the monies due
by me
agreeable to an article of agreement entered into between myself and my
Brothers Michael and Richard Cavett, shall be paid out of the monies now
due me
from Walter King or Walter King & Company and that all my just debts and
funeral charges be paid out of my estate. Second My Will is that my wife
Agness
shall have and enjoy the tract of land whereon I now live during her
natural
life and at her death, that the said tract of land be exposed to public
sale by
my Executor herein after named, after giving public notice thereof, and
that
the condition of the sale be one third the purchase money to be paid
hand,
one third in one year and the remaining one third two years from such
sale and
that the right of property shall not be changed by such sale until the
purchaser shall have made the first payment and given Bond with approved
securities for the payment of the remaining two thirds of the purchase
Money---Third I
give to my wife Agness seven head of cattle her choice of my stock, my
Waggon, Geers, farming Utensials, and Household Furniture. Fourth the
residue of
my stock except my young mare which I have heretofore given to my son
Thomas,
and a heifer which I have heretofore given to my Grand son Phillip, and
my
Smith and other tools…property I direct may be sold by my Executrix and
Executor herein after named giving the usual credit, my land, before
mentioned
excepted, Fourth I give to my son Thomas and to Grand son Phillip each
One
Hundred Dollars, from which no deduction is to be made in case of
deficiency of my
Estate as to other legacys, to be by my Executrix and Executor
hereinafter
named Appropriated to Schooling and clothing them.
Fifth; the residue of my Estate to wit, the monies due to me and which
may
arise from the sales heretofore authorised to be made, and all other
Estate, I
give to my Children Sons and daughters, my son Thomas included, share and
share alike, deducting from the share of my son John, One hundred and
Sixty six
and two thirds dollars, and deducting from the share of my son Richard
three
hundred and thirty three and one third dollars,
Lastly- I do appoint my beloved Wife Agness my Executrix and my friend
Hugh
Walker of Knox County Executor of this my last Will and Testament hereby
revoking and making void all and every Will and Wills by me heretofore
made.
