STATE OF MISSISSIPPI, CLARK COUNTY - James BALLARD to Henry W. CAVE - Deed of
Trust - This indenture made and entered into this twenty forth day of March
in the year of our Lord one thousand eight hundred and forty five between
James BALLARD of the county and state aforesaid of the first part, and Henry
W. CAVE of the second part same county and state witnesseth that the said
party of the first part for an in consideration of the sum of three thousand
five hundred dollars to him in hand paid by the said party of the second part
at and before the ensealing and delivery of these presents, have this day
bargained sold and delivered unto the said party of the second part in trust
the following described Negro slave for life and other property to wit, a
Negro man named Prince aged about thirty five years, a Negro woman named
Ester aged about twenty two years and her child named Bob, aged about one
year and a Negro girl aged three years also two horses and all my right title
intrest and claim in and to a certain crop of cotton now growing on South
West quarter of Section Number Six, Township 3 of Range 15 East & S. W. 1/4
Sec 6 T3 R15 East, as well as my crop of corn now growing on said lands to be
delivered at the usual harvest season to the said party of the second part to
be by him disposed of to his own proper use benifit and behoof, and it is
further agreed and stipulated between the parties of the second part and
first part that if the said party of the first part, shall will truly and
punctuly pay to the party of the first part the sum of three thousand dollars
on or before the first day of May in the year of our Lord one thousand eight
hundred and forty five that then this deed of trust shall be therefore null
and void to all intents and purposes, that the said Negroes, houses cotton
corn and all other property herein conveyed or intended to be, revert back to
the party of the first part as fully and ampley as though this deed of trust
had never been executed. And it is further agreed and stipulated by and
between the said parties of the first and second parts, that in case the said
party of the first part should fail to pay to the said party of second part,
the said sum of money last mentioned in this instrument by the day and time
above heretofore stipulated the said party of the second may and shall have
power and such power is hereby granted by the said party of the first part to
proceed after giving ten days notice in a newspaper published in the Town of
Paulding in said state and called the Eastern Clarion and posting three
similar notices in three public places in said county of Clark to sell all or
any part of the property herein conveyed in trust or intended so to be, the
said of the first part hereby ratifying such sale or sales and giving and
granting full and ample power to the said party of the second part to give a
complete and lawful title to the said property In witness whereof the said
party of the first part has hereto set this hand and affixed his seal this

5 Ap. 1758, aged 92, he asked permission to succeed him, which was not
granted. He remained pastor of the Savoy Church till his sudden death, 23
Aug. 1767. He was on the Commission of the Royal Bounty for the relief of
poor French Protestants. Married, 4 Ap. 1753, Judith Chamier, and left six
children, three of whom died young: (a) Jean Ezechiel, III., the eldest son,
took the name of Chamier (see Chamier Ped.); (b) Dorothée-Sophie, b. 21 Sept.
1755, bapt. 12 Oct., Savoy; married John Mackie and d. at Vevey in 1819; (c)
Suzanne-Judith, b. 7 Oct. 1759, bapt. 9 Oct. Savoy; married the Rev. Thomas
Cave Winscorn, Vicar of Wirkworth, and d. in 1820.[p.35]
