those of you who have been around
awhile will remember MAISER, the
service I started these (and 900 or so other) lists on. It was brought
down
by a spammer who protested his innocence.
Since then I've been spammed by his ads several more times (via other
unfortunate servers). He is now being sued. I am including a message
from
the attorney asking for information. If you have information PLEASE SEND
IT
TO PETE WELLBORN, NOT ME.
Dear Larry:
I enjoyed talking to you today and appreciate any help that you
and
your subscribers are able to provide in my battle against Sam Khuri
("Khuri") and Benchmark Print Supply ("Benchmark"). As I told you, I
am
the
Co-Chairman of the Internet & New Technologies Practice Group ("INTECH")
at
Arnall, Golden & Gregory, LLP (a 100+ attorney firm in Atlanta,
Georgia).
I
was the lead attorney for EarthLink in its legal victory over Cyber
Promotions, Inc. in 1998, and have devoted a substantial part of my
practice
over the last few years to fighting spam. I currently represent
BiblioTech,
Ltd. (a London, England-based provider of free e-mail services under the
trade name "postmaster") in a suit against a number of spammer/spoofers,
including Khuri and Benchmark.
In this lawsuit, Khuri makes, among of others, the following
claims,
which will sound familiar to you and your users in the wake of the
Benchmark
spoofing incident in May 1997 that involved the Maiser servers:
* that he has never "directly" sent out unsolicited e-mails;
* that any bad deeds were done by a third-party contractor,
whose
name Khuri has lost; and
* that he has never received a written complaint regarding his
e-mail practices.
I would appreciate any input from you or your subscribers that
may
help disprove these claims or that may otherwise prove helpful in
building
the case against Benchmark. Such information may include details
concerning
e-mails or written transmissions sent to or from Khuri or even telephone
conversations with Khuri. Ultimately, I may want to obtain an affidavit
from you and/or any of your users with particularly "juicy" Benchmark
