South Carolina Newberry District
In the name of God Amen, I, Thomas Cate of Newberry District, & State
aforesaid, being weak body but of sound and disposing mind and memory,
calling to mind the mortality of the body & knowing that-it-is appointed for
all mankind to die, have thought proper to make and ordain this to be my last
will and testament, in manner and form following, viz,
First of all I will that my body be buried in decent Christain form.
Secondly, I will to my beloved wife Urith Cate Ten Acres of land (word
adjoining added) where on I now live with the improvements thereon being all
the real estate that I pofsefs, during her natural life and at her death to
revert back to my Estate. Also I give and bequeath unto my said wife Urith,
the following property, which I received by her subject to the same and all
encumberances which it was under at the time I received the same, to wit-a
negro man named Moses- a negro woman named- Rachel and her Child named
Lewis-and the increase of said negro woman Rachel. also one bed & furniture
& a sorrel Horse named Jack & her saddle(side. Thirdly----The whole of the
ballance of my personal property consisting of negroes, Horses, Cattle, Hogs,
Household and Kitchen furniture, I will and depose of in the manner and form
following to wit-after paying all my just and lawfull debts (the property
being sold on a credit of Twelve months) I give & bequath to my grand son
Thomas Fawcett one hundred dollars-and to my grand daughter Polly Fawcett one
hundred and thirty five dollars-then the ballance of the nett proceeds of the
sale of my property (after payment of my debts as above required) to be
Equally divided amongst my children & the Heirs of their body share and share
alike Viz. to the Children of any deceased Heir, a share Equal to one of the
Heirs of my body.
Fourthly--- I do nominate constitute and appoint-my sons Ezra Cate & Robert
Cate Executors of this my last will and Testament.
Signed sealed published pronounced and declared to be the last will and
Testament of the Testator the 23rd day of July in the year of our Lord one
thousand eight-hundred and sixteen and forty ferst-year of the sovereignty &
Independence of the United States of America In presence of us- The word
adjoining interlined before signed.
