In the name of God, Amen. I Jacob Cassell of Frederick County in the State of Maryland,
being far advanced
in years but of sound and disposing mind memory and
understanding and considering the certainty of death
and the uncertainty of the time thereof and being
desireous to settle my worldly affairs and thereby be the
better prepared to leave this world where it shall please
God to call me hence. Do therefore make and publish this
my last will and Testament in manner and form
following: -
First and principally I commit my soul into the
hands of almighty God and my body to the earth to be
decently buried at the discretion of my Executors herein
after named and after my debts and funeral charges are
paid. I devise and bequeath as follows: -
Item. I give and bequeath unto my beloved wife
Margaret Cassell all my Household and Kitchen furniture
and also all my personal property that I may die possessed of,
Except bonds, Notes and Cash to dispose as (Serveth) her good I also give and bequeath
unto my beloved wife Margaret, the

One third part of the residue of my personal Estate that
I may die possessed of to dispose of she may think prosperous.
Item. I give and bequeath unto my daughter Mary Peters the sum of four hundred and
seventy six pounds current money. -
Item. I give and bequeath unto my son John Cassell the sum of fifty pounds current
money. –
Item. I give devise and bequeath unto my son Joseph Cassell my House and lott in the
City of Baltimore it being the property convey’d to me by John E. Howard by deed
bearing date the fourth day of May Eighteen hundred
and three to him the said Joseph Cassell his heirs and
assigns forever. –
All the residue of my Estate I give and bequeath
unto my sons and daughters namely= to Henry Cassell, John
Cassell, Abraham Cassell, George Cassell, Joseph Cassell,
David Cassell, Mary Peters and Rachel Waggoner to be
equally divided amongst them share and share alike –
property to be deeded as hereinafter directed. –
And further it is my will and I hereby direct authorize
and empower my Executors hereinafter named, should
I out live my beloved wife, to nominate and appoint two
disinterested persons of Credit to value and allott to each
of my heirs hereinbefore named, Such portions of any
Household furniture or personal property that I may
leave at my death as near equal as they in their
Judgement shall conceive to each before named and such
valuation and allotment, shall be binding on the person
or persons allotted to receive the same. –
And Lastly I do hereby nominate, Constitute and
appoint my sons Henry Cassell and John Cassell sole
Executors of this my Last Will and Testament, revoking
and annulling all former wills by me heretofore,
ratifying and confirming this and none other to be
my Last Will and Testament. – In witness whereof I
have hereunto set my hand and affixed my seal
this fourth day of February in the year of our Lord
Eighteen hundred and Eighteen. -

On the 20th day of April 1818, then came
Henry Cassell & John Cassell and made Oath on the
Holy Evangely of almighty God that the foregoing
Instrument of writing is the true whole will and
Testament of Jacob Cassell, late of Frederick County
deceased , that hath come to their hands and possession
and that they do not know of any other. –

Frederick County, to wit,
On the 20th day of April 1818, then came John
Nicodemus & William Durbin Jr. two of the subscribing witnesses to the foregoing Last
will and testament of Jacob Cassell late of Frederick County deceased, and made Oath on
the Holy Evangely of Almighty God that they did see the testator therein named Sign and
seal this will, that they heard him publish, pronounce, and declare the same to be his
Last
Will and Testament, that all the time of his doing, he
was to the best of their apprehensions of a sound and
disposing mind memory and understanding, that they
together with Nicholas Durbin the other subscribing
witness, respectively subscribed their names as witnesses
to this will in the presence and at the request of the
Testator and all in the presence of each other. –
