He died 30th July, 1725: Invt. œ447-03-08. Taken 10 August, 1725, by
Joseph Case, Andrew Robe, Sen., and John Humphries. Will dated 28 July,
1725.
I, Samuel Case, Sener, being visited with sudden sickness, do make this
my last will and testament: I give to Elizabeth my wife the use and
improvement of my dwelling house and homestead, with half the orchard
thereon, during her natural life. Item. I give to my son Samuel Case the
land lying on Walnut Hill which was quitclaimed to me from the Town, to
be reckoned to him at inventory price, and œ10 more than the rest of the
brethren and sisters; also a piece of swamp land bounded southerly on
Cadwell's land and easterly on land that goes to Hartford, he paying the
money that he has promised (about œ8) to Nathaniel Goodwin, and what it
amounts to at inventory price to be reckoned to him in part of his
portion, not exceeding œ8 more. Item. I give to the rest of my children
the rest of my estate to be equally divided amongst them, only my son
Nathaniel Case to have 5 acres of land joyning on his brother Samuel
Case's swamp before mentioned, which he hath made some improvement on
already, and also excepting my daughter Irenia. I give her an equall
share excepting œ15 which I have already given her. I appoint my sons,
Samuel Case, Nathaniel Case and Jonah Case, my executors.

Court Record, Page 107--2 November, 1725-6: Caleb Case, a minor, 14
years of age, chose his brother Samuel Case of Simsbury to be his
guardian. Recog., œ50. Arriam Case, a minor, 17 years of age, and
Benjamin Case, 15 years of age, chose their brother Samuel Case to be
their guardian. Recog., œ100.
Page 193--3 May, 1728: Peletiah Case, a son of sd. decd., and Josiah
Alverd, who married one of the daughters, complain to this Court that
the executors refuse or neglect to dist. the estate according to the
will. This Court appoint Jonathan Westover, Joseph Case and Joseph
Phelps to dist. the real estate according to sd. will.
