David Carwile apparently died in Autauga County, Alabama between 13 March 1845 when his
will was signed and 7 September 1846 when his son, Zachariah Carwile presented the will
for probate. I have transcribed both the will and the petition for probate and have
included them in this post. These documents appear to contradict some of the information
for David's family that appears in "The Book". The book lists only three
children for David but these documents imply there were at least nine children.

In the name of God Amen I David Carwile in the County of Autauga and State of Alabama
being mindful of my mortality do this March the 11th day in the year of our Lord One
thousand eight hundred and forty five I do make and publish this my last will and
testament in manner following first I desire to be decently buried at my old place and
[---- -- --- -- ----], I give and bequeath unto my Grand daughter Martha Jane Carwile 1 -
four cows & calves the pick of my stock 2- also I give and bequeath unto my Grand
daughter M Alice Carwile four cows & calves of my stock, 3 Also, I give and bequeath
unto my Grand daughter Mary Ann Carwile of my stock four cows and calves 4 Also I give
unto my Grand daughter Sarah Jane Carwile four cows & calves 5. Also I give unto my
Grand Son Francis Marion Carwile one wagon and two mules one mans saddle & bridle, 6.
Also unto my Grand son Crawford Green Carwile I give and bequeath one half of the balance
of the stock cattle 7 Also I give unto my Gra!
nd Son William David Carwile the other half of the stock cattle and all of my other
available property between the two, also I give and bequeath unto my Daughter Margaret
Maliss Johnson one bed, 9 Also I give and bequeath unto my Daughter In Law Harriet J.
Carwile one bedsted & clothes and the rest of my furniture, also I give and bequeath
my Son In Law Neil Harrel one Dollar also I give and bequeath unto my son Zachariah
Carwile twenty steers which I want him to kill next fall and pay my debts out of them,
also I give and bequeath unto my son John Carwile one dollar out of the money arising out
of the sum of the steers [---] also Mary Livingston one dollar out of the same, I now
appoint my son Z. Carwile my executor of this my last will and testament In witness
whereof I have hereunto set my hand and seal this March 13th day AD, 1846

Court of said county Isaiah Nolin & James Barber two of the subscribing witnesses to
the foregoing will who being duly sworn deposeth and saith that they saw the testator
David Carwile execute the same by making his mark that they [---] deponants subscribe
their names as witnesses thereto in the presence of the said testator and that they saw
Alfred W. Jones the other subscribing witness sign the same in the presence of the said
testator and [---] testator was at the time of sound mind and memory.

Special Orphans Court September 7 1846
This day came Zachariah Carwile and present a paper for probate purporting to be the last
will & testament of David Carwile decd whereupon the court ordered that citation issue
to John T. Carwile Mary Livingston wife of George Livingston Malissa Johnson wife of
Robert Johnson & Neal Harrel the next best friend of Sarah Jane & Barton Harrel
(minor) resident heirs of the estate of Decd to be and appear at a Regular Orphans Court
to be holden at Kingston in said county on the 4th Monday in Sept inst to show cause if
any they have why the same should not be admitted to probate & recorded as the last
will & testament of said David Carwile decd
Ordered that publication be made in the Montgomery Advertiser notifying the [---]
nonresident heirs of the estate of David Carwile to wit Catharine Peeples Wm Carwile David
Carwile Elizabeth Irvin wife of Jno Irvin Susshana Sandford & Jane Nelson wife of Wm
Nelson that a paper purporting to be the last will & testament of said decd has been
presented to the court for probate and that they be and appear at a Regular Orphans Court
to be holden at Kingston in said county on the 4th Monday in Sept inst & show cause
why the same not be probated & recorded.
